Source text - English Dear Residents of St. Eustatius,
For me it is important to update the community of St. Eustatius on developments regarding the Plan of Action, Multi-Annual Plan and procedures for appointing a new Island Governor.
As mentioned at the end of 2015 the Plan of Action provides a number of concrete suggestions and proposed action points, which should lead to the improvement of administrative and decision-making processes on St. Eustatius. For the past several months I have worked together with the Executive Council to start implementing this plan.
The Plan of Action briefly outlines how ‘good governance’ can be achieved and supported. The mentioned action points are based on and are linked mainly to previously identified bottlenecks that were also raised through administrative signals, signals with the civil service and also signals from people of the island.
From January 15th, 2016 until December 31st, 2016, the Minister of the Interior Affairs and Kingdom Relations has imposed preliminary supervision. This means that no financial obligations may be entered into the expense of the 2016 budget of the Public Entity of St. Eustatius unless the Minister of the Interior and Kingdom Relations has approved this. Furthermore, the ban on commitments has been lifted giving the Executive Council more freedom and flexibility to operate.
With the implementation of preliminary supervision the Minister wants to ensure the Executive Council operates within the financial frameworks submitted by the Executive Council and approved by the Island Council and that proper procedures are applied.
Together, we have started with the 10 main priorities that must be tackled. The most important was the filling of important vacancies within the civil service. This is important because this way the advisory support to the Executive Council is once again restored.
There are now 2 process managers appointed: Mrs. Patricia Hassell who works on behalf of the Kingdom Representative and Mr. Laurens Duiveman on behalf of the Executive Council. Together, they will ensure that all points of the Plan of Action are prepared for the meeting of the Kingdom Representative and the Executive Council after which the Executive Council will make the necessary decisions.
Other key positions that are to be temporarily filled, with support from the Ministry of the Interior affairs and Kingdom Relations, are Census Office and financial management support. Within short, a new temporary Island Secretary will be appointed. At the same time, the regular process will be started within the framework of the vacant positions, which must be permanently filled.
Meanwhile, the first arrangements were also adjusted: auditing, mandating, control protocol and the regulation for budgetary control. These are important documents for the civil service organization to be able to carry out its work independently and efficiently.
During various visits to St. Eustatius and via a weekly video conference I have held meetings with the Executive Council to discuss the purpose of the plan and how to work out the Plan of Action focusing on the interest of the island and the people of St. Eustatius.
The Plan of Action is a public document, also available in English under publications on the RCN website. Therefore you can read for yourself which are the action points mentioned. Going forward the Executive Council and the Kingdom Representative will communicate jointly on the progress of the Plan of Action.

Het is belangrijk voor mij om de gemeenschap van Sint Eustatius op de hoogte te brengen van de stand van zaken betreffende de ontwikkelingen met betrekking tot het Plan van Aanpak, het Meerjarenplan en de procedure voor de benoeming van een nieuwe Gezaghebber.
Zoals vermeld eind 2015 bevat het Plan van Aanpak een aantal concrete suggesties en voorgestelde actiepunten die moeten leiden tot de verbetering van de bestuurlijke inrichting en besluitvormingsprocessen op Sint Eustatius. Gedurende afgelopen maanden heb ik met het Bestuurscollege samengewerkt om een begin te maken met de uitvoering van dit plan.
Het Plan van Aanpak beschrijft in het kort op welk wijze ‘goed bestuur’ kan worden bevorderd en ondersteund. De benoemde actiepunten zijn gebaseerd op en sluiten vooral aan op eerder geconstateerde knelpunten die ook vanuit bestuurlijke en ambtelijke signalen en signalen van inwoners van het eiland naar voren zijn gebracht.
De Minister van Binnenlandse Zaken en Koninkrijksrelaties heeft van 15 januari 2016 tot en met 31 december 2016 voorafgaand toezicht ingesteld. Dit betekent dat er geen financiële verplichtingen mogen worden opgenomen in de budgetuitgaven voor 2016 van het Openbare Lichaam Sint Eustatius, tenzij de Minister van Binnenlandse Zaken en Koninkrijksrelaties dit heeft goedgekeurd. Daarnaast is het verbod op toezeggingen opgeheven, waardoor de Bestuurscollege met meer vrijheid en flexibiliteit kan handelen.
Met de instelling van voorafgaand toezicht wil de minister ervoor zorgen dat de Bestuurscollege handelt binnen de financiële kaders die door de Bestuurscollege zijn ingediend en door de Eilandsraad zijn goedgekeurd en dat de juiste procedures worden toegepast.
We zijn gezamenlijk begonnen met de 10 belangrijkste prioriteiten die moeten worden aangepakt. De voornaamste was het invullen van belangrijke vacatures binnen het ambtelijk apparaat. Dit is belangrijk omdat de adviesondersteuning aan de Bestuurscollege zo weer wordt hersteld.
Er zijn nu 2 procesmanagers aangesteld: Mevrouw Patricia Hassell verricht werkzaamheden namens de Rijksvertegenwoordiger en de heer Laurens Duiveman namens de Bestuurscollege. Samen zullen zij de voorbereidingen treffen voor alle punten van het Plan van Aanpak ten behoeve van het overleg van de Rijksvertegenwoordiger en de Bestuurscollege, waarna de Bestuurscollege de nodige beslissingen zal nemen.
Andere sleutelposities die met behulp van het Ministerie van Binnenlandse Zaken en Koninkrijksrelaties tijdelijk zijn ingevuld, zijn Burgerzaken en ondersteuning financieel beheer. Binnenkort zal er een nieuwe tijdelijke Eilandssecretaris worden benoemd. Tegelijkertijd zal het reguliere proces worden opgestart in het kader van de vacatures die permanent moeten worden ingevuld.
De eerste regelingen zijn inmiddels ook aangepast: audit, mandaat, controleprotocol en de regelgeving voor budgettaire controle. Dit zijn belangrijke instrumenten die het mogelijk maken dat het ambtelijk apparaat zijn werk onafhankelijk en efficiënt kan uitvoeren.
Tijdens verschillende bezoeken aan Sint Eustatius en via een wekelijkse videoconferentie heb ik overleg gevoerd met de Bestuurscollege om het doel van het plan te bespreken en hoe het Plan van Aanpak moet worden uitgewerkt, waarbij de focus ligt op het belang van het eiland en de bevolking van Sint Eustatius.
Het Plan van Aanpak is een openbaar document dat ook beschikbaar is in het Engels op de RCN-website onder publicaties. U kunt dus zelf lezen wat de genoemde actiepunten zijn. In de toekomst zullen de Bestuurscollege en de Rijksvertegenwoordiger gezamenlijk berichten over de voortgang van het Plan van Aanpak.

Vastgoedbelasting wordt jaarlijks geheven van degene die op 1 januari van een jaar gerechtigd is tot de voordelen uit een onroerende zaak die is gelegen in Caribisch Nederland. Meestal is dit de eigenaar van de zaak. Over de grond die in erfpacht is uitgegeven wordt de vastgoedbelasting geheven van de erfpachter van de grond.
De vastgoedbelasting wordt niet geheven over de waarde van:
1) de eigen woning: een woning die een eigenaar als hoofdverblijf ter beschikking staat en waarvan de eigenaar inwoner is van Caribisch Nederland;
2) onroerende zaken die behoren tot het ondernemingsvermogen van een IB onderneming (b.v. een eenmanszaak).
Daarnaast geldt een vrijstelling van vastgoedbelasting voor onder andere:
1) braakliggende gronden met een particuliere eigenaar die inwoner is van Caribisch Nederland;
2) de eerste USD 70.000 van de waarde van alle tweede woningen die onder de vastgoedbelasting vallen. Deze vrijstelling geldt vanaf 1 januari 2014. Deze vrijstelling is ook van toepassing voor woningen die in het bezit zijn van NV’s en BV’s, stichtingen etc.
Het Eilandgebied Bonaire heft over de waarde van de eigen woning grondbelasting. De Eilandgebieden Saba en Sint Eustatius heffen geen grondbelasting.
Wat betekent dit in de praktijk?
In de praktijk betekent het dat de vastgoedbelasting onder meer geldt voor:
1) eigenaren van tweede woningen in Caribisch Nederland;
2) eigenaren die onroerende zaken in Caribisch Nederland verhuren;
3) binnen Caribisch Nederland gevestigde NV’s en BV’s, stichtingen etc., die onroerende zaken in Caribisch Nederland houden;
4) buiten Caribisch Nederland gevestigde NV’s en BV’s, stichtingen etc., die in het bezit zijn van onroerende zaken in Caribisch Nederland;
5) niet ingezetenen die grond in erfpacht of eigendom hebben in Caribisch Nederland.
Waarover wordt de vastgoedbelasting geheven?
Vastgoedbelasting wordt geheven over het voordeel uit de onroerende zaak. Het voordeel van het bezit van de onroerende zaak, is wettelijk vastgesteld op 4% van de waarde van de zaak, ongeacht de werkelijke opbrengst.
De waarde van de onroerende zaak wordt gesteld op de waarde in het economische verkeer. De verschuldigde belasting is dus afhankelijk van de waarde van de onroerende zaak. De waarde wordt door de inspecteur vastgesteld voor een tijdvak van vijf jaren. Als de waarde tussentijds verandert als gevolg van verbouwing, uitbreiding of sloop, kan de inspecteur de waarde opnieuw vaststellen voor het resterende tijdvak.
Tarief
Vanaf 1 januari 2015 is het belastingtarief 17,5% over het berekende voordeel. Effectief wordt er dus een belasting geheven van 0,7% (17,5% x 4%=0,7%) over de waarde van de onroerende zaak. Indien het een hotel betreft is het tarief 10% en wordt er effectief 0,4% (10% x 4%=0,4%) belasting geheven.
Wijzigingen
Met ingang van 1 januari 2014 zijn waardestijgingen als gevolg van investeringen de eerste tien jaren vrijgesteld. Indien u een beroep op deze vrijstelling wilt doen, dient u daarvoor bij de Belastingdienst het formulier verzoek om toepassing investeringsvrijstelling aan te vragen. Na indiening van dit formulier ontvangt u van de inspecteur een beschikking waarin het bedrag van de vrijstelling is vastgesteld.
Voorbeelden
1) U bezit op 1 januari 2015 een onroerende zaak met een waarde van USD 200.000, en het betreft een tweede woning. Voor een tweede woning geldt een vrijstelling van USD 70.000,-. De belasting wordt berekend over USD 130.000. U betaalt daarover 0,7% vastgoedbelasting (=USD 910). In 2016 bouwt u een porch ter waarde van USD 50.000 aan het gebouw. Op 1 januari 2017 bent u nog steeds eigenaar van de woning. Door de investeringsvrijstelling wordt, gedurende 10 jaar, de waarde van de porch niet opgeteld bij de waarde van de onroerende zaak. De belasting wordt nog steeds berekend over een waarde van USD 130.000.
2) Een vennootschap bezit in 2015 een onroerende zaak met een waarde van USD 500.000. Het betreft een woning. Met ingang van 2014 geldt voor woningen die geen hoofdverblijf zijn van de eigenaar (tweede woningen) een vrijstelling van USD 70.000,-. Deze vrijstelling is ook van toepassing op lichamen.
De belasting wordt berekend over USD 430.000. Over 2015 betaalt het lichaam daarover 0,7% vastgoedbelasting (= USD 3010).
3) Een vennootschap bezit in 2015 een hotel met een waarde van USD 300.000. Er is geen vrijstelling van toepassing. Voor hotels in bezit van een niet natuurlijke persoon bedraagt het belastingtarief 10%. Effectief wordt dus 0,4% belasting geheven (= USD 1200).
Opcenten
Het eilandgebied Bonaire heft 15% opcenten. Het bedrag aan opcenten wordt apart opgenomen op de aanslag vastgoedbelasting en wordt berekend over het bedrag van de aanslag vastgoedbelasting.
Indien de aanslag vastgoedbelasting USD 1200 is, dan is het bedrag aan opcenten USD 180. De totale heffing in dat jaar bedraagt dan USD 1.380.
Als een onroerende zaak onder de vastgoedbelasting valt, hoeft u hiervoor geen grondbelasting te betalen.

Vastgoedbelasting (real estate tax) is levied on an annual basis on those who are entitled to the benefits of an immovable property which is located in the Caribbean Netherlands on 1 January of any year. Usually this is the owner of the object. However in the case of long-term lease of land [erfpacht], the vastgoedbelasting is levied on the lessee.
The vastgoedbelasting is not levied on the value of:
1) the owner-occupied house: a house which is available to the owner, who is a resident of the Caribbean Netherlands, as main residence;
2) immovable properties which form part of the assets of businesses which are subject to IB [income tax] (for example a sole proprietorship).
Furthermore, exemption from vastgoedbelasting applies to amongst others:
1) undeveloped land owned by a private individual who is a resident of the Caribbean Netherlands;
2) the first USD 70,000 of the value of all second homes which fall under the vastgoedbelasting. This exemption is applicable as of 1 January 2014. This exemption also applies to residential property which is owned by public limited and limited liability companies, foundations, etc.
The Island Territory Bonaire levies grondbelasting (land tax) on the value of the owner-occupied house. The Island Territories Saba and Statia do not levy grondbelasting.
What does this mean in practice?
In practice this means that the vastgoedbelasting is applicable to, amongst others:
1) owners of second homes located in the Caribbean Netherlands;
2) owners that rent out immovable property located in the Caribbean Netherlands;
3) public limited and limited liability companies, foundations, etc. which are established in the Caribbean Netherlands and which own immovable property located in the Caribbean Netherlands;
4) public limited and limited liability companies, foundations, etc. which are established outside the Caribbean Netherlands and which own immovable property located in the Caribbean Netherlands;
5) non-residents who own leasehold land or freehold land located in the Caribbean Netherlands.
What is the assessment basis of the vastgoedbelasting?
The vastgoedbelasting is levied on the benefit derived from the immovable property. This benefit is a legally fixed percentage of 4% of the value of the immovable property, regardless the actual income it generates.
The value of the immovable property is established on its fair-market value. Consequently, the vastgoedbelasting due depends on the value of the property. This value is determined by the tax inspector for a period of five years. In case the value changes in the interim as a result of a reconstruction, extension, or demolition, the tax inspector can reassess the value for the remainder of the period.
Rate
As of 1 January 2015, the tax rate has been set at 17.5% on the calculated benefit. Effectively this means that a tax rate of 0.7% (17.5%x4%=0.7%) is levied on the value of the immovable property. In case it concerns a hotel, the rate is 10% and 0.4% (10%x4%=0.4%) tax is effectively levied.
Changes
As of 1 January 2014, the increase in value of immovable property as a result of investments is exempted for the first ten years. If you want to use this exemption, you should request the form for application of the investment exemption from the Belastingdienst.
After submitting this form you will receive a decision from the inspector in which the amount of the exemption is established.
Examples
1) On 1 January 2015 you own an immovable property in the Caribbean Netherlands with a value of USD 200,000 and it concerns a second home. An exemption of USD 70,000 applies to a second home. The tax is calculated on a value of USD 130.000. You pay a vastgoedbelasting rate of 0.7% (=USD 910) on this amount. In 2016 you add a porch worth USD 50,000 to the property.
On 1 January 2017 you are still the owner of the residential property. Due to the investment exemption, the value of the porch is not added to the value of the immovable property during the first ten years. The tax is still calculated on the value of USD 130,000.
2) A company owns an immovable property worth USD 500,000 in 2015. It concerns a residential property. With effect from 2014, an exemption of USD 70,000 applies to residential properties which are not the main residence of the owner (second homes). This exemption also applies to entities.
The tax is calculated on USD 430,000. The entity pays 0.7% vastgoedbelasting (=USD 3010) over 2015.
3) A company owns a hotel worth USD 300,000 in 2015. An exemption does not apply. For hotels owned by a non-natural person, the tax rate is 10%. Effectively, this means that 0.4% tax (=USD 1200) is levied.
Surtax
Island Territory Bonaire levies 15% surtax. The amount of the surtax is stated separately on the vastgoedbelasting assessment and is calculated on the amount of the vastgoedbelasting assessment.
If the vastgoedbelasting assessment is USD 1,200, the amount of surtax amounts to USD 180. The total levy in that year then amounts to USD 1380.
When an immovable property is subject to vastgoedbelasting, no grondbelasting is due.
