El Santo moldeó su leyenda luchando contra zombis, momias y mujeres vampiro. Venció a centenares de rivales peleando cuerpo a cuerpo en las arenas de los gladiadores mexicanos. Los tiempos modernos, sin embargo, han traído nuevos enemigos al linaje de la máscara más popular de la lucha libre mexicana, un popular espectáculo en el país desde 1933. Esta semana, El Hijo del Santo salió victorioso de una batalla que duró casi siete años y que tuvo como escenario el tortuoso sistema de justicia mexicano. Lo que inició como un pleito penal por el uso de la imagen del luchador derivó en una defensa de su derecho por mantenerse en el anonimato.
Para los luchadores enmascarados no hay mayor vergüenza que revelar el rostro. El Santo, que protagonizó 54 películas, solo lo hizo público una vez. La ocasión fue tan rara que la fecha quedó marcada: el 26 de enero de 1984. El Hijo del Santo no imaginó el vendaval que enfrentaría cuando decidió demandar a la Triple AAA, la empresa que organiza las populares batallas de lucha libre desde 1992. La compañía comercializó en 2010 sin el consentimiento del luchador un vídeo grabado en junio de 2009 de Triplemanía XVII, un espectáculo encabezado por él, La Parka, Octagón y El Vampiro canadiense, entre otros. Jorge Ernesto Guzmán (el nombre real de El Hijo del Santo) acudió a los tribunales para frenar la venta del DVD y exigir 350.000 pesos (20.000 dólares) por la reparación del daño.
El caso tomó un giro inesperado cuando Marisela Peña Herrada, la demandada, pasó a la ofensiva con un recurso de revocación. En los juzgados la empresaria dijo que el litigio había sido iniciado por Jorge Ernesto Guzmán y no por el personaje de ficción que aparecía enmascarado en las comparecencias judiciales. Exigió que el demandante enfrentara todo el juicio con el rostro al descubierto para comprobar que era quien decía ser. El 12 de marzo de 2012, El Hijo del Santo tuvo que quitarse la máscara ante el juez, el secretario de acuerdos y el letrado de la acusada en el Quinto Tribunal de Materia Penal. “Soy yo, Marisela. Tú sabes que soy yo”, se escuchó decir al rostro desnudado por la tela.
Eso no bastó a Peña, que trató que todas las diligencias públicas fueran presenciadas por Guzmán y no por El Hijo del Santo, pero este se negó. Las leyes mexicanas le dieron la razón con un fallo en octubre de 2014. La empresaria no se dio por vencida y alargó los recursos hasta que el asunto llegó a la Suprema Corte de Justicia. Este miércoles, los cinco ministros de la Primera Sala decidieron en favor de El Hijo del Santo permitiéndole preservar su anonimato y le dieron la razón en el litigio frente a la Triple AAA.
El Hijo del Santo comenzó su carrera en 1982, justo cuando su padre estaba cerca del retiro. Ya lejos de los cuadriláteros, donde solía batirse apostando la máscara para buscar cortar la cabellera de sus rivales, se ha convertido en un hábil empresario que explota su personaje en series animadas, cómics y productos como camisetas y otras prendas. El Santo, “The Saint,” molded his legend fighting against zombies, mummies, and lady vampires. He defeated hundreds of rivals fighting hand to hand in the arena of Mexican gladiators. Modern times, however, have brought new enemies to the lineage of the most popular masked fighter in all of Mexican “lucha libre,” a popular spectacle in the country since 1933. This week, El Hijo del Santo, “The Son of the Saint,” came out victorious in a battle that lasted almost seven years and had the winding Mexican justice system as the arena. What started as a lawsuit over the use of the luchador’s image became a defense of his right to maintain his anonymity.
For masked luchadores there is no greater shame than having their face revealed. El Santo, who starred in 54 movies, publicly showed his face only once. The occasion was so rare that, for many fans, the date is marked: January 26, 1984. That day, in front of television cameras, the fighter took off his legendary silver mask on a talk show on the channel Televisa. He died 10 days later at 66.
But masked luchadores also have a private life. On March 12, 2012, El Hijo del Santo had to take off his mask in front of the judge, the court clerk, and the defendant’s lawyer in Mexico’s Fifth Criminal Court. “It’s me, Marisela. You know who I am,” the uncovered face behind the curtain was heard to say.
This wasn’t enough for Peña, who tried to force all public court appearances be made by Guzmán, not Hijo del Santo, but he was denied. The law found in Guzmán’s favor in October 2014. The businessman did not give up, and stretched his resources until the case went to the Mexican Supreme Court.
