หมวดที่ 6 เงินเดือน ค่าจ้าง ค่าล่วงเวลา ค่าทำงานในวันหยุดและโบนัส
ข้อ 6.1 บริษัทฯ จะจ่ายเงินเดือน ค่าจ้าง ค่าล่วงเวลา และ ค่าทำงานในวันหยุดให้แก่พนักงานทุกๆ วันที่ 30 ของทุกเดือน โดยผ่านธนาคาร หากวันจ่ายเงินเดือนวันใดตรงกับวันหยุดประจำสัปดาห์หรือวันหยุดตามประเพณีให้เลื่อนการจ่ายเงินเดือนเข้ามาจ่ายในวันก่อนหน้าที่จะถึงวันหยุดนั้น
ข้อ 6.2 หลักเกณฑ์การทำงานล่วงเวลาและการทำงานในวันหยุด
ในกรณีที่งานมีลักษณะหรือสภาพของงานต้องทำติดต่อกันไป ถ้าหยุดจะเสียหายแก่งานหรือเป็นงานฉุกเฉิน บริษัทฯ จะให้พนักงานทำงานล่วงเวลาในวันทำงานหรือทำงานในวันหยุดรวมถึงล่วงเวลาในวันหยุดได้เท่าที่จำเป็น
ในกรณีที่มิใช่งานตามวรรคหนึ่ง บริษัทฯ อาจให้พนักงานทำงานล่วงเวลาในวันทำงานหรือทำงานในวันหยุดรวมถึงล่วงเวลาในวันหยุดได้เป็นครั้งคราว โดยจะต้องได้รับความยินยอมจากพนักงานก่อนในแต่ละคราวไป
การทำงานล่วงเวลาในวันทำงาน ทำงานในวันหยุดและล่วงเวลาในวันหยุดตามวรรคสองต้องไม่เกินสัปดาห์ละ 36 ชั่วโมง
ข้อ 6.2.1 ค่าล่วงเวลา พนักงานที่ทำงานเกินเวลาทำงานปกติตามคำสั่งของผู้บังคับบัญชามีสิทธิได้รับค่าล่วงเวลาดังนี้
การทำงานเกินเวลาทำงานปกติในวันทำงาน จะได้รับค่าล่วงเวลาในอัตราหนึ่งเท่าครึ่งของอัตราค่าจ้างต่อชั่วโมงในการทำงานปกติ
สำหรับเวลาที่ทำเกินการทำงานเกินเวลาทำงานปกติในวันหยุด จะได้รับค่าล่วงเวลาในอัตราสามเท่าของอัตราค่าจ้างต่อชั่วโมงในการทำงานปกติสำหรับเวลาที่ทำเกิน
ข้อ 6.2.2 ค่าทำงานในวันหยุด พนักงานที่ทำงานในวันหยุดตามคำสั่งของผู้บังคับบัญชามีสิทธิได้รับค่าทำงานในวันหยุดดังนี้
การทำงานในวันหยุด ซึ่งพนักงานผู้นั้นมีสิทธิได้รับค่าจ้างในวันหยุดนั้น (ผู้ได้รับค่าจ้างเป็นรายเดือน) จะได้รับค่าทำงานในวันหยุดเพิ่มขึ้น อีกหนึ่งเท่าของค่าจ้าง ตามจำนวนชั่วโมงที่ได้ทำงานในวันหยุด
การทำงานในวันหยุดซึ่งพนักงานผู้นั้นไม่มีสิทธิได้รับค่าจ้างในวันหยุดนั้น (ผู้ได้รับค่าจ้างเป็นรายวัน) จะได้รับค่าทำงานในวันหยุดเป็นสองเท่าของค่าจ้างปกติในวันทำงานตามจำนวนชั่วโมงที่ได้ทำงานในวันหยุด
หมายเหตุ ในการคำนวณค่าล่วงเวลาหรือค่าทำงานในวันหยุดให้คำนวณจากค่าจ้างและให้ถือว่าเวลาทำงานในวันหนึ่งเท่ากับ 8 ชั่วโมง และเดือนหนึ่งมี 30 วัน
สำหรับพนักงานหญิงที่มีครรภ์ให้ทำหนังสือแจ้งผู้บังคับบัญชาทราบเป็นลายลักษณ์อักษร เพื่อที่ผู้บังคับบัญชาจะได้ไม่มอบหมาย สั่งการทำงานล่วงเวลาระหว่างเวลา 21.00-06.00 น. ทำงานในวันหยุด ทุกกรณีและงานที่เป็นอันตรายต่อลูกจ้างหญิงที่มีครรภ์ | Translation - English
Section 6 Salary, Wages, Overtime, Holiday Pay and Bonus
Item 6.1 The Company will pay salary, wages, overtime, holiday pay and bonus to all employees on the 30th day of every month by bank transfer. In case that the pay day falls on weekends or public holidays, payment will be made on the previous business day.
Item 6.2 Working regulations for overtime and holidays
In case that the type or nature of the work requires continuous performance failing which damage would be caused or where the work is of an urgent nature, the Company may require an employee to work overtime on workdays or work on holidays or work overtime on holidays where necessary.
Other works other than those stated in paragraph one, the Company may required an employee to work overtime on workdays or work on holidays or work overtime on holidays occasionally on the basis of his/her prior consent for each time.
Working overtime during workdays or working on holidays or working overtime on holidays as stated in paragraph two shall not exceed 36 hours per week.
Item 6.2.1 Overtime pay An employee working overtime under the supervisor’s authorisation is eligible to overtime pay as follows:
Working overtime on workdays shall be paid at 1½ times the rate of the hourly basic pay earned in normal working days.
Working overtime on holidays shall be paid at 3 times the rate of the hourly basic pay earned in normal working days as per work hours performed on holidays.
Item 6.2.2 Holiday pay An employee working on holidays under the supervisor’s authorisation is eligible to holiday pay as follows:
Working on holidays for an employee (receiving a monthly wage) eligible for holiday pay shall be paid at 1 time the rate of the hourly basic pay earned in normal working days as per work hours performed on holidays.
Working on holidays for employees (receiving a daily wage) eligible for holiday pay shall be paid at 2 times the rate of the hourly basic pay earned in normal working days as per work hours performed on holidays.
Remarks Calculation of overtime or holiday pay shall be based on the rate of basic pay and that 1 workday consists of 8 work hours whereas 1 month consists of 30 days.
A pregnant female employee shall notify her supervisor in a written document so that she shall not be assigned overtime work between 21.00 and 06.00 hrs, holiday work in any cases and harmful work for a pregnant female employee. |
