El Consell de XXX ha presentado un escrito de alegaciones al Anteproyecto de ley agraria de las Islas Baleares. El conseller de Agricultura, Ganadería y Pesca del Consell de XXX, XXX, ha explicado que "este anteproyecto no permite impulsar la recuperación del campo, según los criterios territoriales de este gobierno. Encontramos que faltan acciones para incentivar la recuperación de campos que hace años que no se trabajan, medidas de impulso a la agricultura ecológica, favorecer el cultivo tradicional o fomentar la recuperación de variedades autóctonas".

Para XXX "el Estatuto de las Islas Baleares establece que la agricultura es competencia propia de los consells insulars, no compartimos la decisión del Govern de atribuirse competencias reglamentarias en materia agraria". El conseller de Agricultura tampoco comparte "la decisión de dejar sin efecto cualquier norma que exija la declaración de interés general para la implantación de actividades agrarias y complementarias, y que esto se haga en aras de la simplificación administrativa cuando al mismo tiempo se exigen más informes de más consellerias del propio Govern".

Para el titular de Agricultura del Consell de XXX, el anteproyecto "favorece más el uso especulativo del suelo que no el uso agrario, este anteproyecto no se adapta a las peculiaridades del territorio de XXX. En Mallorca o Menorca, el sector agrario es relativamente más fuerte que en XXX, y es posible encontrar municipios pocos desarrollados con mucho suelo agrícola, que serían territorios para los que esta ley podría llegar a tener algún sentido".

The XXX has presented a text dilineating the administration's own observations and comments on a draft bill for the new agricultural law of XXX. XXX, councillor of agriculture, fishing and livestock asserted “by this administration's territorial and land use standards, the proposed bill does not allow for a revival of the island's rural areas. We are still waiting to see proposals that incentivise a renewal of long-abandoned land parcels, measures that promote eco-friendly agriculture and other motions that would favour traditional farming practises and boost production of local products”.

XXX stated: “The Statute of XXX places agriculture and farming within the domain of the local island councils. We do not agree with the decision by the XXX to accord itself law-writing authority on such matters.” Neither does the councillor of agriculture agree with “the decision to take the legs out from underneath any decree requiring attestations of benefit to the general public interest as a condition to instating primary or secondary agricultural activity. We find it upsetting that these changes – defended as being part of a move toward administrative simplification – are made at a time when the regional XXX administration itself is requiring its own interior departments to provide ever greater quantities of documentation”.

Councillor XXX contends that the draft bill “gives more preference to land speculation than to use of it for agrarian purposes” and that “it fails to adapt to the territorial particularities of XXX. On XXX or XXX, where farming industries are relatively stronger than here on XXX, there may exist a certain number of under-developed municipalities with an over-supply of farmable land, and these would be areas where the proposed law might make sense”.

El ple del Consell de XXX, reunit aquest matí en sessió extraordinària, ha aprovat per unanimitat tramitar davant del Tribunal Constitucional un conflicte de defensa de l'autonomia local de XXX contra determinats preceptes de la Llei agrària de les Illes Balears aprovada el passat 16 de desembre.

Els arguments que basen aquest conflicte de defensa “ja varan ser presentants en forma d'al·legacions durant el tràmit de la Llei, en concret en les fases d'avantprojecte i de projecte de Llei, els passats mesos d'agost i setembre, sense que fossin acceptades”, ha manifestat XXX, conseller d'Agricultura, Ramaderia i Pesca del Consell de XXX.

En el transcurs de la sessió, el secretari del Consell, XXX ha detallat els arguments jurídics que fonamenten aquesta decisió, i que són fonamentalment dos.

D'una banda hi ha els arguments relacionats amb el dret civil propi d'Eivissa i de Formentera. XXX ha dit que “no té en compte (en referència a la Llei agrària) l'explotació a majoral pròpia de XXX com a contracte tradicional d'explotació agrícola”. Es dóna la circumstància que la mateixa Llei sí que “té en compte l'anomenada societat rural menorquina”.

La llei “tampoc té en compte la figura dels tornalls, pròpia de l'escala territorial, mental i peculiar de les Pitiüses, i pren com a referència per a mesurar la terra les quarterades del dret agrari mallorquí”.

Per altra banda, hi ha una vulneració de les competències pròpies del XXX reconegudes per l'Estatut de XXX en urbanisme, turisme i ordenació territorial quan “permet l'acampada lliure en determinades explotacions agrícoles, i les fomenta, sense tenir en compte que aquesta pràctica XXX la té prohibida, fins i tot aquesta illa compta amb un règim sancionador explícit contra aquesta pràctica”, ha dit XXX.

In a one-off plenary session held this morning in the XXX Council plenary hall, participants voted unanimously to challenge a recently-approved farming law before Spain's constitutional court. The Council's case challenges the legality of specific portions of the Llei agrària de les Illes Balears ('Balearic agrarian law'), ratified 16 December of last year, on the grounds that it challenges the autonomy of the local administration.

The basis for the claims “were already put forth in August and September as comments submitted during the draft phases of the bill,” explained XXX, councillor of agriculture, livestock and fishing of the XXX Council, adding: “At that time they were not heeded”.

During the morning plenary, XXX Council secretary XXX detailed what he said were the two principal legal arguments behind the rejection of the farming law.

The first of these concerns civil law on Eivissa and Formentera. According to XXX: “[The law] fails to recognise XXX's traditional system of stewarded farming as the traditional farming contract”. As chance would have it, XXX says, the law does recognise the system traditionally in use in Menorca – known as 'societat rural menorquina'.

According the secretary, the law also fails to take into account the role of tornalls – “a unit of measurement which exists on farms in Eivissa and Formentera and one that is altogether unique to the particular territorial and psychological reality in the Pitiüses”. Instead, the law uses the unit of measurement known as the quarterada – “a standard in Mallorcan agrarian law”.

The law also would appear to encroach upon the authority of the XXX Council as established by the sections on urbanism, tourism and town planning of the Statute of Autonomy of the Balearic Islands. As Secretary XXX explained: “The Llei agrària permits and even promotes unrestricted camping on certain farming plots, completely ignoring the fact that XXX has not only prohibited such activity, it has in place a system of penalties against it.”

El Ministerio de Agricultura, Alimentación y Medio Ambiente ha estimado que el consumo de bolsas de plástico por habitante y año es de 145 unidades por habitante, un 50% menos que hace cinco años.

Con esta estimación, la prohibición que ha hecho XXX sobre su territorio ha evitado la distribución de 1.740.000 bolsas, convirtiéndose en uno de los líderes entre los municipios que han aplicado esta acción, prevista en el Plan Nacional de Residuos estatal 2008-2015.

Durante este año, los servicios de inspección del área de Medio Ambiente del XXX han realizado tareas de información en todos los establecimientos locales y han iniciado 7 expedientes sancionadores por incumplir la norma de distribuir bolsas de plástico entre los clientes.

The Ministry of Agriculture, Food and the Environment has estimated that 145 plastic bags are used per person per year, 50% less than five years ago.

Based on these figures, the ban on bags in XXX amounts to forestalling the distribution of 1,740,000 plastic bags. The move was proposed as part of the 2008-2015 national plan on waste disposal and its local adoption has turned XXX into one of the programme's leading participants.

Over the past year, staff inspectors of the XXX's office of the environment have led outreach campaigns at island businesses and, in the case of seven stores, work by inspectors has also led to injunctions being brought for violations of the plastic bags ban.

XXX, councillor of the environment, explained: “The move away from petroleum-based plastic bags is a question of vital importance for the natural beauty of our land and waters and the health of many marine species that ingest the bags accidentally”. For the councillor, “replacing such bags with more natural, less durable substitutes –like the potato and wheat starch-based options that currently exist– is a low-effort action that can be extremely beneficial to the environment”.

XXX ha augmentat de manera notable els percentatges de recollida selectiva per sobre de la pujada dels residus en massa en aquest any 2014. Tant la recollida de paper, com de vidre i envasos s'han situat per sobre de l'increment de la població mentre que la pujada de la fracció de rebuig es situa per baix d'aquest llindar. De manera notable, els millors resultats s'han produït en la recuperació d'envasos, que ha millorat un 25% respecte l'any 2013.

Pel que fa als residus en massa, els que la ciutadania llença en els abocadors de rebuig, aquest any 2014 se n'han generat a XXX 7215 tones, per 6841 l'any 2013. Això significa que en un any ha pujat un 5,47%. Cal tenir en compte que la població de XXX ha pujat un 7,5% al darrer any ja que l'1 de gener de 2014 l'Institut Nacional d'Estadística registrava 11.548 habitants i l'1 de gener de 2015, 12.423. En aquest fet cal afegir l'impacte afegit que suposa haver tingut una especialment bona temporada turística, ja que de maig a setembre la taxa d'ocupació hotelera va ser del 80,45% al 2014 i de 78,10% al 2013.

Una dada curiosa és que el mes de l'any 2014 que ha registrat menys residus ha estat febrer, amb 253 tones. Per contra, el mes en el que s'han generat més residus ha estat agost, amb 1192 tones, multiplicant gairebé per cinc el volum de residus entre un mes i un altre.

Increases in recyclable waste collection on XXX significantly outstripped increases in normal waste collection in 2014. The rate of paper, glass and plastic collection showed steeper growth than the population curve itself, while gains in normal rubbish collection paled in comparison. Plastic recycling was the undisputed leader in growth, experiencing an upsurge of 25% compared to 2013 figures.

In terms of standard waste collection – the rubbish tossed by XXX that ends up in the local tip – , the year 2014 saw the island generating 7,215 tonnes compared to 6,841 tonnes the year before – equivalent to an increase of 5.47 percent. During this same period the local population grew by 7.5% (on 1 January 2014 the Institut Nacional d'Estadística registered 11,548 residents; one year later this number had jumped to 12,423). It should also be noted that 2014 bore witness to an usually busy summer season, one during which May-through-September occupancy rates were 80.45% compared to 78.10% twelve months earlier.

Curiously, the month in 2014 that logged the most unimpressive collection figures was February (253 tonnes). Comparisons in August—when, at 1,192 tonnes, the figure was at its yearlong high—reveal growth by a factor of nearly five.
