Nynější onemocnění a průběh hospitalizace:
4,5 letý chlapc, přijat pro 4. relaps nefrotického syndromu.
Při přijetí mírný respirační infekt charakteru KHCD, oteklý, laboratorně nízké zánětlivé parametry, nefrotická proteinurie (odpad 9g/l). Byla zahájena terapie plnou dávkou Prednisonu. Diurezu bylo nutno podporovat diuretikem, i přes terapii Prednisonem nadále přetrvávala pozitivní bilance tekutin. Hypoproteinémie a hypalbuminémie si vyžádala substituci albuminem, byly podány dw pulzy Solu-Medrolu. Klinicky dítě odmítalo p.o. přijem, mělo nauzeu, několikrát zvrácel, řídší stolico, současně došlo k progresi otoku v oblasti tváři a krku, sonograficky verifikován nález odpovídající parotititě. Laboratorně elevace amylázy. Ve výtěrech nebyl nalezen patogen, virologie s nálezem aktivní infekce Chlamydia pneumonie – byla zahájena ATB terapie makrolidovým antibiotikem. Vzhledem k opakováně zachycené leukocyturii byla odebrána kultivace, s nálezem Morganella morgani (v kvantitě 10*5, při kontrole 10*3), bakterie je špatně citlivá. Cytochemický nález v moči se spontánně normalizoval, po domluvě s mikrobiologem nález nebyl indikován k terapii, pouze ke kontrolám. Několik ní (ještě před nasazení Klacidu) se u chlapce objevoval výsev toxoalergického exantemu na hrudníku, který dobře reagoval na podání Dithiadenu, postupně vymizel. Na sono byla popsána progrese pleurálního výpotku a ascitu při hypoproteinemii.
Po týdenní léčbě se klinický stav pomalu vylepšil, obnovil se p.o. přijem, postupně regredovaly otoky i výpotky, byl převeden na alternativní podání Prednosonu. Laboratorně při kontrole již minimalizace proteinurie. Na p.o. terapii Fromilidem [chlapce] propouštíme domů. Maminka byla prostřednictvím tlumočníka nefrologem znovu poučena o problematice nefrotického syndromu a nutnosti dodržovat doporučení.

On admission suffering from a mild respiratory catarrhal infection in the upper respiratory tract, swollen, low inflammatory parameters established in the lab, nephrotic proteinuria (waste 9g/l). Therapy with a full dose of Prednisone was initiated. It was necessary to support diuresis with a diuretic, the positive fluid balance remained despite the Prednisone. Albumin substitution was required due to hypoproteinaemia and hypoalbuminaemia, two pulses of Solu Medrol were administered. Clinically the child refused oral intake, he was nauseous and vomited several times, his stools were loose, at the same time his face and neck continued to swell up, symptoms consistent with mumps verified by ultrasound. Raised amylase levels established by lab. No pathogens in the swabs, presence of an active infection of Chlamydophila pneumoniae virologically established. Treatment initiated with macrolide antibiotics. Due to repeated leucocyturia a culture was collected, and Morganella Morganii was found (in quantity of 10*5, control 10*3), poorly susceptible bacteria. The cytochemical findings in the urine normalised spontaneously, after consultation with a microbiologist this finding was not indicated for treatment, just for checks, for several days (before Klacid was administered) a toxo-allergic exanthemic rash appeared on the boy’s chest, which responded well to Dithiaden and gradually disappeared. The sonogram displayed a progressive pleural effusion and ascites due to hypoproteinaemia.
After a week of treatment his clinical condition slowly improved, oral intake was restarted, the swelling and effusion gradually regressed, changed to an alternative administration of Prednisone. Lab checks established that the proteinuria was already minimising. After oral administration of Fromilide we will send [the boy] home. The nephrologist informed Mum again, through an interpreter, of the problems caused by nephrotic syndrome and the need to follow the recommendations

Odôvodnenie

Ministerstvo spravodlivosti SR podľa ustanovenia § 12 ods. l Zákona č. 549/2011 Z.z. o uznávaní a výkone rozhodnutí, ktorými sa ukladá trestná sankcia spojená s odňatím slobody v Európskej únii a o zmene a doplnení Zákona č. 221/2006 Z.z. o výkone väzby v znení neskorších predpisov (ďalej len „ZoUaV“), zaslalo Krajskému súdu v Košiciach Osvedčenie Zboru väzenskej stráže Škótska zo dňa 17. júla 2014 o vydaní právoplatného rozsudku Vrchného súdu Glasgow zo dňa 8. apríla 2009, právoplatného 8. apríla 2009, sp.zn. [...], na rozhodnutie o uznaní a výkone uvedeného právoplatného rozhodnutia, a to v rozsahu v ktorom sa týka [mena], nar. [dátum] v Gelnici, okres Gelnica, trvalé bytom [adresa] okres [...], t.č. vo výkone trestu odňatia slobody Spojenom kráľovstve Veľkej Británie a Severného írska („ďalej len odsúdený“).
Krajský súd v Košiciach (ďalej len „vykonávajúci súd“), upovedomil Ministerstvo spravodlivosti SR a súčasne požiadal v zmysle § 13 ods. 2 ZoUaV o súhlasné stanovisko, ktoré Ministerstvo spravodlivosti SR zaslalo vykonávajúcemu súdu dňa 22.júla 2014 a toto mu bolo doručené dňa 28. júla 2014.
Vykonávajúci súd z príloh k Osvedčeniu (najmä lustrácie v registri obyvateľov) zistil, že odsúdený je štátnym občanom Slovenskej republiky s adresou pobytu [adresa], okres [...].
Príslušný spisový materiál týkajúci sa odsúdeného bol zaslaný v zmysle § 15 ods. l ZoUaV na vyjadrenie Krajskej prokuratúre Košice, ktorá svoje vyjadrenie zo dňa 20.1.2015 doručila vykonávajúcemu súdu dňa 23.1.2015.
Z predmetného vyjadrenia vyplýva, že podľa názoru Krajskej prokuratúry Košice sú splnené podmienky na uznanie a výkon rozsudku Vrchného súdu Glasgow (Škótsko) - Spojené kráľovstvo Veľkej Británie a Severného írska zo dňa 8. apríla 2009, sp.zn. [...], ktorý nadobudol právoplatnosť dňa 8.apríla 2009. Vo svojom vyjadrení krajská prokuratúra navrhla uznať trest v celkovej dĺžke 25 rokov.
Podľa ustanovenia § 12 ods. l ZoUaV, na konanie o uznaní a výkone rozhodnutia je príslušný krajský súd, v ktorého obvode má odsúdený obvyklý pobyt alebo vykonáva trest odňatia slobody; inak je príslušný Krajský súd v Bratislave. Ak konanie o uznaní a výkone rozhodnutia začne na základe konania o európskom zatýkacom rozkaze, príslušným na konanie o uznaní a výkone rozhodnutia je krajský súd, ktorý koná o európskom zatýkacom rozkaze. The Ministry of Justice of the Slovak Republic, under the provisions of Section 12(l) of Act no. 549/2011, on the recognition and enforcement of judgments imposing criminal penalties associated with imprisonment in the European Union and on the amendment to and extension of Act No. 221/2006, on the enforcement of remand custody, as amended (hereinafter LREJ), forwarded to the Regional Court in Košice the Certificate issued by the Guards in a Scottish prison on [date] 2014 on the final judgment issued by the High Court in Glasgow on [date] 2009, which came into legal force on [date] 2009, ref. [...], regarding the decision on the recognition and enforcement of the said final judgment, insofar as it relates to [name], born on [date] in [town], district of [...], permanent address [...] district of [...], currently serving a prison sentence in the United Kingdom of Great Britain and Northern Ireland (hereinafter the Offender).

The Regional Court in Košice (hereinafter the executing court), notified the Ministry of Justice of the Slovak Republic, and simultaneously requested an opinion within the meaning of Section 13(2) of LREJ, which the Ministry of Justice of the Slovak Republic forwarded to the executing court on [date] 2014 and which was received by the said court on [date] 2014.

From the annexes to the Certificate (especially the entry in the population register) the executing court established that the Offender is a citizen of the Slovak Republic with the residential address [...], district of [...].

In accordance with Section 15(1) of LREJ, the relevant file regarding the Offender was forwarded for the statement of the Regional Public Prosecutor of Košice, who delivered her statement of [date] 2015 to the executing court on [date] 2015.

From the statement in question it transpires that, in the opinion of the Regional Public Prosecutor of Košice, the conditions for the recognition and enforcement of the judgement of the High Court of Glasgow (Scotland) – the United Kingdom of Great Britain and Northern Ireland of [date] 2009, ref. [...], which came into legal force on [date] 2009, have been met. In her statement the Regional Public Prosecutor proposed acceptance of the punishment of a total of 25 years’ duration.

Pursuant to the provisions of Section 12(1) of LREJ, the Regional Court within whose jurisdiction the Offender has his normal residence or is serving a prison sentence is the competent court for proceedings on the recognition and enforcement of judgments; otherwise the Regional Court in Bratislava is competent. If the proceedings for the recognition and enforcement of a judgment are intiated on the basis of a European Arrest Warrant, the Regional Court acting on the European Arrest Warrant is the competent court for the proceedings on the recognition and enforcement of a judgment. If proceedings on the recognition and enforcement of a judgement are intiated, the competent court must notify the Ministry.

Cameroun, Affaire Thierry Atangana : La France exprime son courroux
Le Quai d'Orsay n’apprécie pas l’absence des avocats de l'Etat du Cameroun lors de l'audience du 9 août dernier. Pour les Français, c'est de la provocation pure et simple. Dans notre dernière édition, le reporter de Dikalo relevait la déception de Patricia Parachini, chef section consulaire à l’ambassade de France au Cameroun. Après la suspension de l'audience qui devait consister en l'entame de la Cross examination - exercice au cours duquel le parquet et les avocats de la partie civile posent des questions à l'accusé, la diplomate, sous les regards d’une dizaine de gendarmes chargés de l’escorte du détenu franco-camerounais, a lancé un coup de fil téléphonique dont le destinataire ne nous pas été dévoilé.

Ce geste de la diplomate française avait tout son sens, surtout qu'il démontrait à suffisance qu'elle transmettait au moins é sa hiérarchie le mépris dont est victime la France par rapport à ce procès. « Le plus choquant dans ce dilatoire, est que les avocats de la partie civile ont été aperçus au tribunal au moment de l'ouverture de l'audience », nous dévoile-t-on. Il se dit d’ailleurs qu’un avocat qui défend les Intérêts de l’Etat du Cameroun, vouerait une haine viscérale â Michel Thierry Atangana. Peut-être que la partie civile n'a plus d'arguments A présenter au Tribunal, après avoir pris part è l’examination in chief de Michel Thierry Atangana qui s'est achevé lors de l'audience du 26 juillet 2011.

Le cas échéant, pourquoi ne demanderait-t-elle pas tout simplement au parquet de faire appliquer l'Art 64 du Nouveau Code de procédure pénale qui stipule : « le procureur général près une Cour d'Appel peut, sur autorisation écrite du Ministre chargé de la Justice, requérir par écrit puis oralement, l'arrêter Ies poursuites pénales à tout stade de la procédures avant l'intervention d'une décision au fond, lorsque ces poursuites sont de nature â compromettre l'intérêt social ou la paix public ; (2) Dans le cas prévu au paragraphe premier du présent article, le Juge d'instruction ou la juridiction de jugement constate son dessaisissement sur l’action publique et donne main levée des mandats éventuellement décernés contre le bénéficiaire de l’intérêt des; poursuites; (3) Lorsque l'action publique a été arrêtée, en application de l'alinéa 1er, le juge d'instruction ou la juridiction de jugement poursuit l'instruction ou l'examen de l'affaire sur l'action civile ; (4) L'arrêt des poursuites n'empêche pas leurs reprises lorsque celles-ci se révèlent nécessaires ; (6) En dehors des cas prévus à l'alinéa 1er ci-dessus, l'action publique ne doit être, de quelque façon que ce soit, â peine de prise à partie contre le magistrat intéressé, ni suspendu, ni arrêté ».
Pour le moins, la France pense que la nouvelle attitude des avocats de la partie civile constitua le début d'un autre dilatoire visant à fragiliser davantage Michel Thierry Atangana qui a déjà passé plus de 14 ans de détention dans une cellule au Secrétariat d'Etat à la Défense chargé de la gendarmerie.

The French Foreign Office at the Quai d’Orsay is not pleased by the fact that the state of Cameroon’s lawyers were absent from the hearing of the 9 August last. The French perceive this as provocation, pure and simple. In our last edition, our reporter in Dikalo noted the disappointment of Patricia Parachini, Head of the Consular Section at the French Embassy in Cameroon. Following suspension of the hearing, which at the start should have consisted of cross examination – an exercise during which the prosecution and the plaintiffs’ lawyers put questions to the accused, the diplomat, observed by the dozens of gendarmes charged with escorting the Franco-Cameroonian prisoner, made a phone call to someone whose identity has not been revealed to us.
This gesture by the French diplomat was of paramount importance, underscoring emphatically that she was communicating to her superiors the distrust felt towards France with regard to this trial. “The most shocking thing about this delaying tactic is that the plaintiff’s lawyers were seen in court at the very beginning of the hearing,” we are told. Moreover, it is said that one of the lawyers defending the interests of the state of Cameroon nurses a visceral hatred of Michel Thierry Atangana. Maybe the plaintiffs have no more arguments to present to the Court, after having participated in the main examination of Michel Thierry Atangana which concluded out of court on 26 July 2011.
Should the question arise, why did she not quite simply ask the Prosecution to apply Article 64 of the New Criminal Procedure Code, which stipulates: “The Public Prosecutor at a Court of Appeal may, with written authorisation from the Minister of Justice, request orally or in writing the cessation of criminal proceedings at any point prior to a substantive decision, if the nature of the proceedings could compromise corporate interests or public order; (2) in the case provided for by the first paragraph of this article, the investigating judge or trial court must establish the divestiture of the public action and freely allow any warrant issued against the beneficiary in the interest of the proceedings; (3) when the public action has been halted pursuant to the first section, the investigating judge or trial court should continue the trial or hearing in the case of civil action; (4) the halting of the proceedings should not prevent them from resuming should this prove to be necessary; (5) Outwith the cases provided for in the first section above, public action should not, in any case whatsoever, be taken against the judge concerned, who should not be suspended or arrested.”
At the very least, France thinks that the new position of the plaintiffs’ lawyers constitutes the start of more delaying tactics, which aim further to weaken Michel Thierry Atangana, who has already spent more than 14 years detained in a cell at the Ministry of Defence, in the charge of the police.

Regeste

Berufung gegen ein Teilurteil bei Stufenklagen (Art SO Abs. 1 OG).
Gegen ein Teilurteil übereinen Hilfsanspruch im Rahmen einer Stufenklage ist die Berufung unabhängig davon zulässig, ob durch die selbständige Anfechtung ein bedeutender Aufwand an Zeit oder Kosten für ein weitläufiges Beweisverfahren erspart werden kann (E. 2).
Sachverhalt ab Seite 140

A.- Die R. AG und die I. AG schlossen am 19. Februar 1990 eine als "Zessionsvertrag" bezeichnete Vereinbarung. Danach zedierte die R. AG der I. AG zahlreiche Forderungen gemäss den von ihr erstellten und periodisch zugestellten EDV-Listen zum Inkasso. Von den eingegangenen Zahlungen sollte die R. AG einen Anteil von 90%, die I. AG einen solchen von 10 % erhalten. Zudem wurde eine feste Gebühr von jährlich Fr. 500.- vereinbart. Das Bonitätsrisiko trug die I. AG, die R. AG haftete nur für den Bestand der abgetretenen Forderungen.

BGE 123 III 140 S. 141

Nachdem es zu Unstimmigkeiten zwischen den Parteien gekommen war, kündigte die I. AG mit Schreiben vom 18. März 1991 den Vertrag per 18. Januar 1992. Mit Schreiben vom 8. April 1992 verlangte die R. AG die Rückzession der noch offenen Forderungen und die Endabrechnung.
Am 19. November 1993 reichte die R. AG beim Handelsgericht des Kantons Zürich Klage gegen die I. AG ein. Mit Teilurteil vom 7. Juli 1995 verpflichtete das Handelsgericht die Beklagte unter Strafandrohung, der Klägerin bis zum 15. September 1995 über die Abwicklung der übertragenen Geschäfte vollständig Auskunft sowie über die ihr zum Inkasso zedierten Forderungen vollständig Abrechnung zu erteilen.
Die Beklagte hat das Teiiurteil des Handelsgerichts mit Berufung angefochten, die vom Bundesgericht abgewiesen wird.

Auszug aus den Erwägungen:

Erwägung 2

2.- Das Handelsgericht des Kantons Zürich führte im angefochtenen Urteil aus, die Klägerin könne eine Rechnungslegungs- und eine unbezifferte Geldforderungsklage in der Form der Stufenklage verbinden. Es sei daher vorab zu prüfen, ob die Beklagte auskunfts- und abrechnungspflichtig sei.
In der Folge bejahte die Vorinstanz diese Frage und hiess die Rechtsbegehren 1 und 2 im Teilurteil vom 7. Juli 1995 gut.
a) Das angefochtene Urteil bereinigt die Streitlage zwischen den Parteien nicht umfassend und ist daher kein Endentscheid im Sinne von Art. 48 OG (POUDRET, Commentaire de Sa loi fédérale d'organisation judiciaire, Vol. II, Bern 1990, N 1.1.7.1 zu Art. 48 OG mit Hinweisen). Teilurteile sind nach der Rechtsprechung selbständig anfechtbar, wenn die davon erfassten Begehren zum Gegenstand eines gesonderten Prozesses hätten gemacht werden können und ihre Beurteilung für den Vollentscheid von präjudizieller Bedeutung ist (BGE107 II 349 E. 2 S. 352 f.). Eine selbständige Anfechtung rechtfertigt sich allerdings ebenso wie bei Zwischenentscheiden allein aus Gründen der Prozessökonomie (vgl. BGE 117II 349 E. 2 S. 350). Die präjudizielle Bedeutung des Teilurteils reicht deshalb für sich allein in der Regel nicht aus, den Weg der Berufung zu öffnen. Zusätzlich ist erforderlich, dass mit der vorgezogenen Anfechtung ein so bedeutender Aufwand an Zeit oder Kosten für ein weitläufiges Beweisverfahren erspart werden kann, dass die gesonderte Anrufung des Bundesgerichts gerechtfertigt erscheint (Art. 50 Abs. 1

Summary

Appeal against a partial judgment in staged actions (Art. 50 Para. 1 of the Federal Law on the Organisation of Federal Justice (OG)).
An appeal against a partial judgment by way of an auxiliary claim in the context of a staged action is admissible regardless of whether a significant expenditure of time or the expense of an extensive evidence-gathering procedure can be spared by the independent challenge. (E. 2).
The facts of the case are on page 140ff.

A.- R. JSC and I. JSC concluded an agreement designated an “Assignment Agreement” on 19 February 1990. Pursuant to the said Agreement, R. JSC assigned to I. JSC numerous claims, in accordance with the computerised lists created by it, which were delivered periodically for debt collection. R. JSC was to receive a 90% share of the payments received and I. JSC a 10% share. In addition, a fixed fee of CHF 500.00 annually was agreed. I. JSC bore the credit risk and R. JSC was liable only for the continued existence of the transferred claims.

Ruling of the Swiss Federal Court 123 III 140 p. 141

After disagreements had arisen between the parties, I. JSC, in a letter dated 18 March 1991, terminated the contract as of 18 January 1992. In a letter dated 8 April 1992, R. JSC demanded the reassignment of any claims still pending and the final account.
On 19 November 1993, R. JSC instituted proceedings at the Commercial Court of the Canton of Zürich against I. JSC. In a partial judgment of 7 July 1995, the Commercial Court ordered the defendant, under threat of penalty, to provide the plaintiff with full information on the winding-up of the transferred business, along with a complete and final bill for the debts assigned to the defendant for collection, by 15 September 1995.
The defendant lodged an appeal to challenge the partial judgment of the Commercial Court; the Swiss Federal Court dismissed this appeal.

2.- In the contested judgment, the Commercial Court of the Canton of Zürich stated that the plaintiff may combine actions for rendering of accounts and for an unquantified monetary claim into a staged action. Whether the defendant is obliged to provide information and accounts must therefore be determined in advance. The lower court subsequently answered this question affirmatively and endorsed legal requests 1 and 2 in the partial judgment of 7 July 1995.
a) The judgment under appeal did not comprehensively settle the dispute between the parties and is therefore not a final decision within the meaning of Art. 48 of the Federal Law on the Organisation of Federal Justice (POUDRET, Commentaire de la loi fédérale d'organisation judiciaire, [A Commentary on the Federal Law on the Federal Organisation of Justice], Vol. II, Bern 1990, Note 1.1.7.1 to Art. 48 of the Federal Law on the Organisation of Federal Justice, with guidance). Partial judgments are independently contestable under case law, if the request contained therein could have been made the subject of separate proceedings and if the adjudication is of a prejudicial nature for the full and final decision (Ruling of the Swiss Federal Court 107 II 349 Deliberation 2 p. 352 f.). An independent challenge, however, is justified for reasons of procedural economy only, as are interim decisions also (cf. Ruling of the Swiss Federal Court 117 II 349 Deliberation 2 p. 350). I love words; I always have. I love languages and am always trying to learn at least one. I have a degree in languages from the University of Cambridge and an MA from the University of Bristol and I also hold DALF (Diplôme approfondi de la langue française/Diploma in advanced French language studies) at level C2. I have the Diploma in Translation (Institute of Linguists) in both French-English and German-English; I am CIoL accredited in all my language pairs and ITI accredited in Czech, Slovak and German to English.

I  worked in the languages industry since 2010 and am now a full-time freelancer. However I have several years' experience as a PM in an agency so am fully aware of the pressures on the other side of the desk.

My translations are always accurate, as I research things obsessively, and formatted to match the layout of the original as closely as possible. You can expect the highest quality from me.
