THE CASE
On 8 April 1986 the applicant, who was then aged 44, underwent a gynaecological operation under general anaesthetic at Strasbourg Hospital. On wakening, she suffered a neurological syndrome. In the days that followed she suffered a further vascular accident and her shoulder was scalded when a cup of tea was upset. Since then she has been 90% disabled; she is hemiplegic, has difficulty coordinating her upper limbs, can speak only with difficulty and suffers from double vision.
On 27 May 1986 the applicant made an urgent application to the President of the Strasbourg Administrative Court seeking the appointment of an expert. In an order of 28 May 1986 1 President appointed an expert, who filed a report on 2 June 1986 in which he concluded that there had not been any medical error.
On 6 August 1987 (after a preliminary claim of 22 June 1987 had been refused) the applicant brought an action for damages against Strasbourg Hospital in the Strasbourg Administrative Court.
In submissions of 21 October 1987 the applicant criticised the findings set out in the report of 2 June 1986 and applied for a detailed, thorough expert opinion.
In a judgment delivered on 25 May 1990 the Strasbourg Administrative Court ordered further inquiries into the facts with a view to commissioning a report from a panel of two experts.
On 23 October 1990 the experts filed the following findings: “As regards the cerebral arterial thromboses that occurred on 8 April and 17 April 1986, nothing in Mrs Kress’s clinical condition or in the results of the tests made them foreseeable. The treatment of this complication was appropriate to the patient’s state of health and in accordance with the current state of scientific knowledge. As regards the scald on the left shoulder, the experts attribute it to a lack of assistance and organisation in the department.”
In a judgment delivered on 30 July 1997 the Conseil d’Etat dismissed the applicant’s appeal on the following grounds: “On th basi of the unappealable assessment it made of the facts, the Nancy Administrative Court of Appeal inevitably held that no-fault liability on the part of the Strasbourg Regional Hospital Centre for the damage relied on by Mrs Kress had not been made out. In so doing, that court did not make any error of law, seeing that it is apparent from the evidence submitted to the courts below that the circumstances in which such liability could be incurred did not obtain.”

27 Mayıs 1986 tarihinde davacı, Strazburg İdari Mahkemesi Başkanı ile bir bilirkişi ile görüşme talebini görüşmek için acil bir başvuruda bulunmuştur. 28 Mayıs 1986 tarihli emriyle Başkan, davacıya bir bilirkişi atamış ve bu bilirkişi, 2 Haziran 1986 tarihinde sunduğu raporunda, hiçbir medikal hata olmadığı görüşünü bildirmiştir.
6 Ağustos 1986 tarihinde (27 Haziran 1981 tarihli ön iddianın reddedilmesinin ardından), davacı zararı için Strazburg Hastanesi’ne, Strazburg İdari Mahkemesi’nde dava açmıştır.
Davacı, 21 Ekim 1987 tarihinde yapılan başvurusunda, 2 Haziran 1986 tarihli raporundaki sonuçları eleştirmiş ve ayrıntılı bir bilirkişi görüşü için başvuruda bulunmuştur.

Hastanın durumu göz alındığında, bu komplikasyonun tedavisi uygundur ve hali hazırdaki bilimsel bilgi ile uyumludur. Sol koldaki haşlanmaya gelince, bilirkişiler bu durumu, (hastaya) yardım yokluğu ve departmandaki organizasyon eksikliğine ithaf etmiştir.”
30 Haziran 1997 tarihli kararında, Danıştay (Conseil d’Etat), davacının talebini şu gerekçelerle reddetmiştir: “Nancy İdari Temyiz Mahkemesi, veriler üzerinden yaptığı temyiz edilemeyecek değerlendirmesi temelinde, Bayan Kress’in uğradığı söylene gelen tahribatta, Strazburg Bölge Hastanesi Merkezi tarafına kesin bir biçimde yasal sorumluluk yüklememiştir. İş bu kararıyla bu mahkeme hiçbir yasal yanlış yapmamış; mahkemeye sunulan delilerin, bu türden bir yasal sorumluluk yükleyecek niteliğin altında kalarak, elde edilmediğini görmüştür.”

From the four temperaments of the Ancient civilizations – sanguine, choleric, melancholic and phlegmatic – to the latest advances in psychology, people have been restless in their pursuit of a good, reliable way to fit something as complex and fluid as human personality into a well-defined model. We are still some time away from being able to do that, although the current models account for the majority of our personality traits and can often predict with a high degree of confidence how we are likely to behave in specific circumstances.
That said, it is important to bear in mind that regardless of which model we rely on, our personality is just one aspect of many – our actions are also influenced by our environment, experience, and individual goals. In our Type Descriptions and Premium Profiles, we describe how people belonging to a specific personality type are likely to behave – however, remember that these are just indicators and tendencies, not definitive guidelines or answers.
