Source text - English This *** Business Partner Agreement for Software Value Plus (“Agreement”) governs your *** Business Partner relationship with *** as a Remarketer and transactions under such relationship in which you market the Products and Services you are approved to market.
1. Definitions
Customer – an End User. The terms “Customer” and “End User” are used interchangeably in this Agreement.
End User –End User is anyone who uses Services or acquires Products for its own use and not for resale.
Enterprise – any legal entity and the subsidiaries it owns by more than 50%. The term “Enterprise” applies only to the portion of the Enterprise located in the Republic of Indonesia.
*** Business Partner (also called “Business Partner”) – a business entity that has an *** Business Partner Agreement with *** under which it is approved to market Programs or Services.
Incentive / Promotion – a rebate, fee, instant discount, or other benefit or compensation *** may make available to Business Partners under this Agreement.
Operations Guide – the processes, procedures, and other pertinent information which *** provides to you in one or more published forms or through our electronic information systems or a combination of both. In particular, information regarding your relationship requirements will be specified in the “Participation Criteria” section of the applicable Operations Guide.
Participation Criteria – the minimum and mandatory requirements specified for the Remarketer types and applicable Software Value Plus Programs and Product Groups that the *** Business Partner must meet and maintain for marketing the Products and Services.

1. Definisi
Pelanggan – seorang Pengguna Akhir. Istilah “Pelanggan” dan “Pengguna Akhir” digunakan dalam Perjanjian ini secara bergantian.
Pengguna Akhir – Pengguna Akhir adalah setiap orang yang menggunakan Layanan atau memperoleh Produk untuk digunakan sendiri dan tidak untuk dijual kembali.
Perusahaan – setiap badan hukum dan anak perusahaan yang dimilikinya dengan kepemilikan lebih dari 50%. Istilah “Perusahaan” berlaku hanya untuk bagian Perusahaan yang berlokasi di Republik Indonesia.
Mitra Bisnis *** (juga disebut “Mitra Bisnis”) – suatu entitas bisnis yang memiliki Perjanjian Mitra Bisnis *** dengan ***, yang berisi persetujuan kepada entitas bisnis tersebut untuk memasarkan Program atau Layanan.
Insentif / Promosi – potongan harga, upah, diskon langsung, atau manfaat atau kompensasi lain yang disediakan oleh *** untuk Mitra Bisnis berdasarkan Perjanjian ini.
Panduan Operasi – proses, prosedur, dan informasi terkait lainnya yang disediakan oleh *** kepada Anda dalam satu atau beberapa bentuk publikasi atau melalui sistem informasi elektronik kami atau kombinasi dari keduanya. Secara khusus, informasi terkait persyaratan hubungan Anda akan ditetapkan dalam pasal “Kriteria Partisipasi” dalam Panduan Operasi yang berlaku.
Kriteria Partisipasi – persyaratan minimal dan wajib yang ditetapkan untuk tipe Pemasar Kembali serta Program Software Value Plus dan Kelompok Produk yang harus dipenuhi dan dipertahankan oleh Mitra Bisnis *** untuk memasarkan Produk dan Layanan.
