Source text - English 15.1 Irrespective of any claims by the Employer or by Third Parties, or the liability of the Joint Venture or the Parties with respect to the Employer or Third Parties, or the liability of the Parties to each other as set forth in Clauses 5.2, 14.1 and above, the Parties agree that in respect of any personal injury to or death or sickness of any employee, servant, sub-contractor or agent of either Party or its subsidiaries or affiliated companies occasioned by and/or arising in the course of performance of the Works at the request of the Joint Venture or either Party, or in respect of damage to or loss of property owned by or contracted to either Party, its sub-contractors or subsidiaries or affiliates occasioned by and/or arising in the course of performance of the Works at the request of the Joint Venture or either Party, the Parties shall bear in equal proportions all costs, expenses, losses, liabilities and damages arising from all such claims, demands or causes of action whether based on breach of contract, negligence or other basis, howsoever the injury, death, sickness, damage or loss is caused and regardless of whether or not caused by the negligent or wrongful conduct of either Parties, affiliates or subsidiaries.
Translation - Arabic 15-2 بصرف النظر عن أي مطالبات يُقدمها صاحب العمل أو الغير، أو مسؤولية المشروع المشترك أو الطرفين فيما يتعلق بصاحب العمل أو الغير، أو مسؤولية الطرفين تجاه بعضهما على النحو المنصوص عليه في البنود 5-2 و 14-1 و15-1 أعلاه ، يتفق الطرفان على أنه فيما يتعلق بأي إصابة شخصية أو وفاة أو مرض يلحق أي موظف أو خادم أو مقاول من الباطن أو وكيل أي طرف من الطرفين أو شركاته الفرعية أو شركاته التابعة والتي تكون نتيجةً لسياق تنفيذ الأعمال أو التي تنشأ عنها بناءً على طلب من المشروع المشترك أو أي طرف من الطرفين، أو فيما يتعلق بالأضرار أو الخسائر في الممتلكات المملوكة أو المتعاقد عليها مع أي طرف من الطرفين أو مقاوليه من الباطن أو شركاته الفرعية أو شركاته التابعة والتي تكون نتيجةً لسياق تنفيذ الأعمال أو التي تنشأ عنها بناءً على طلب من المشروع المشترك أو أي طرف من الطرفين، بأن يتحمل الطرفان بنسب متساوية جميع التكاليف والمصاريف والخسائر والالتزامات والأضرار الناشئة عن جميع هذه المطالبات أو المطالب أو عن جميع أسباب الدعاوى والتي تعزى إلى خرق العقد أو الإهمال أو أي أساس آخر، مهما كان سبب الإصابة أو الوفاة أو المرض أو الضرر أو الخسارة، وبغض النظر عما إذا كان ذلك ناتجةُ عن سلوك إهمال أو سلوك غير مشروع من أحد الطرفين أو الشركات التابعة أو الشركات الفرعية.

14-1 دون المساس بالبنود الأخرى الواردة في الاتفاقية:
أ) يتحمل الطرفان المسؤولية عن الالتزامات والأضرار (إن وجدت) التي يتكبدها المشروع المشترك بموجب هذا العقد وسيضطلعان بدفعها بنسب فائدة المشاركة المُجددة لكلٍ منهما بصرف النظر عن الطرف الذي تسبب في حدوث الأضرار المذكورة أو من يكون مسؤولاً عنها وفقاً لأحكام هذا العقد؛
ب) ينطبق الأمر ذاته على الأعمال التصحيحية أو الالتزامات الأخرى التي يتكبدها المشروع المشترك والتي لا يكون منصوص عليها بالتحديد في مكان آخر بموجب هذه الاتفاقية.
Translation - English 14. DAMAGES / RECTIFICATION
14.1 Without prejudice to other Clauses in the Agreement: -
a) Liabilities and damages (if any) incurred by the Joint Venture under the Contract will be borne and paid by the Parties in the proportion of their respective Participating Interests irrespective of which Party causes or is responsible for the said damages in accordance with the provisions of the Contract; and
b) The same shall apply to rectification work or other liabilities incurred by the Joint Venture and which are not specifically provided for elsewhere under this Agreement
