Dalam Peraturan Menteri ini yang dimaksud dengan:
1. Telekomunikasi adalah setiap pemancaran, pengiriman dan atau penerimaan dari setiap informasi dalam bentuk tanda-tanda, isyarat, tulisan, gambar, suara, dan bunyi melalui sistem kawat, optik, radio atau sistem elektromagnetik lainnya;
2. Alat telekomunikasi adalah setiap alat perlengkapan yang digunakan dalam bertelekomunikasi;
3. Perangkat telekomunikasi adalah sekelompok alat telekomunikasi yang memungkinkan bertelekomunikasi;
4. Jaringan telekomunikasi adalah rangkaian perangkat telekomunikasi dan kelengkapannya yang digunakan dalam bertelekomunikasi;
5. Jasa telekomunikasi adalah layanan telekomunikasi untuk memenuhi kebutuhan bertelekomunikasi dengan menggunakan jaringan telekomunikasi;
6. Penyelenggara telekomunikasi adalah perseorangan, koperasi, badan usaha milik daerah, badan usaha milik negara, badan usaha swasta, instansi pemerintah, dan instansi pertahanan keamanan negara;
7. Penyelenggaraan telekomunikasi adalah kegiatan penyediaan dan pelayanan telekomunikasi sehingga memungkinkan terselenggaranya telekomunikasi;
8. Penyelenggaraan jaringan telekomunikasi adalah kegiatan penyediaan dan atau pelayanan jaringan telekomunikasi yang memungkinkan terselenggaranya telekomunikasi;
9. Penyelenggaraan telekomunikasi untuk keperluan khusus adalah penyelenggaraan telekomunikasi yang sifat, peruntukan, dan pengoperasiannya khusus;
10. Penyelenggaraan jaringan tetap adalah kegiatan penyelenggaraan jaringan telekomunikasi untuk layanan telekomunikasi tetap;
11. Penyelenggaraan jaringan bergerak adalah kegiatan penyelenggaraan jaringan untuk telekomunikasi bergerak;
12. Penyelenggaraan jasa teleponi dasar adalah penyelenggaraan jasa telepon dengan menggunakan teknologi circuit switched atau teknologi lainnya yang berupa jasa telepon, faksimili, teleks, telegraf dan data;
13. Jelajah (roaming) adalah kemampuan yang dimilliki oleh jaringan bergerak seluler yang memungkinkan penggunanya untuk tetap dapat menggunakan layanan di daerah yang belum terlayani oleh suatu penyelenggara jaringan bergerak seluler dengan menggunakan jaringan milik penyelenggara jaringan bergerak seluler lainnya;
14. Jelajah (roaming) nasional adalah jelajah (roaming) yang dilakukan antara 2 (dua) penyelenggara jaringan bergerak seluler dengan cakupan nasional;
15. Penyelenggaraan jaringan tetap tertutup adalah penyelenggaraan jaringan yang menyediakan jaringan untuk disewakan;
16. Interkoneksi adalah keterhubungan antar jaringan telekomunikasi dari penyelenggara telekomunikasi yang berbeda;
17. Uji laik operasi adalah pengujian teknis yang dilakukan oleh lembaga yang telah diakreditasi atau tim yang dibentuk oleh Direktur Jenderal dengan tugas melaksanakan proses pengujian sistem secara teknis dan operasional;
18. Lembaga uji laik operasi adalah lembaga yang berwenang melakukan uji laik operasi dan telah mendapatkan akreditasi dari lembaga yang memiliki kewenangan dalam pemberian akreditasi;
19. Kewajiban pelayanan universal adalah kewajiban yang dibebankan kepada penyelenggarajaringan telekomunikasi dan atau jasa telekomunikasi untuk memenuhi aksesibilitas bagi wilayah atau sebagian masyarakat yang belum terjangkau oleh penyelenggaraan jaringan dan atau jasatelekomunikasi;
20. Rencana dasar teknis adalah ketentuan-ketentuan teknis yang harus diikuti dalam membangundan menyediakan jaringan telekomunikasi sehingga menjamin ketersambungan satu jaringan kejaringan lainnya;
21. Landing right adalah hak yang diberikan oleh Menteri kepada penyelenggara jaringan telekomunikasi, penyelenggara jasa telekomunikasi, atau lembaga penyiaran berlangganan dalam rangka bekerja sama dengan penyelenggara telekomunikasi asing;
22. Menteri adalah Menteri yang ruang lingkup tugas dan tanggung jawabnya di bidang telekomunikasi;
23. Direktur Jenderal adalah Direktur Jenderal Pos dan Telekomunikasi.
24. Direktorat Jenderal adalah Direktorat Jenderal Pos dan Telekomunikasi.

In this Ministerial Decree, the following terms shall have the following meanings:
1. Telecommunication refers to any emission, transmission, and or receipt of any information in forms of symbols, signs, writings, drawings, noises, and sounds through wire, optical, radio or any other electromagnetic systems;
2. Telecommunication tool refers to any equipment used for telecommunication;
3. Telecommunication device refers to a group of telecommunication tools that makes telecommunication possible to establish;
4. Telecommunication network refers to a series of telecommunication devices and their equipment used for telecommunication;
5. Telecommunication service refers to services of telecommunication to fulfill telecommunication needs by using telecommunication network;
6. Telecommunication provider refers to an individual, cooperative, regional government owned enterprise, state owned enterprise, private enterprise, governmental institution, and national security and defense agency;
7. Establishment of telecommunication refers to any activity of telecommunication procurement and service provision allowing telecommunication;
8. Telecommunication network establishment refers to any activity of telecommunication procurement and or service provision facilitating telecommunication;
9. Establishment of telecommunication for special purposes refers to any establishment of telecommunication with special characteristics, purposes, and operations;
10. Establishment of fixed network refers to any activity of establishment of telecommunication network for fixed telecommunication service;

11. Establishment of mobile network refers to any activity of establishment of telecommunication network for mobile telecommunication service;
12. Establishment of basic telephony service refers to any establishment of telephony services using circuit switched technology or any other technologies in forms of telephone, facsimile, telex, telegraph, and data services;
13. Roaming refers to the ability of cellular mobile network to allow its users to keep using the service in areas not yet reached by a provider cellular mobile network by using networks owned by any other providers of cellular mobile network;
14. National roaming refers to a roaming performed by 2 (two) providers of cellular mobile network with a national scope;
15. Establishment of close fixed network refers to establishment of network for rent;
16. Interconnection refers to connectivity among telecommunication networks of different telecommunication providers;
17. Operational acceptance test refers to a technical test performed by any accredited institution or a team established by the Directorate General with a task to conduct technical and operational system tests;
18. Operational acceptance test institution refers to any institution with an authority to perform operational acceptance test and accreditation from any institution with an authority to grant accreditation status;
19. Universal service duty refers to any duty assigned to any provider of telecommunication network and or telecommunication service to achieve accessibility in any area or some community not yet reached by any network or telecommunication service;
20. Technical fundamental plan refers to any technical provisions to be followed in establishing and providing telecommunication network to ensure network connectivity;
21. Landing right refers to a right granted by the Minister to a provider of telecommunication network, provider of telecommunication service, or any subscribed broadcasting institution to establish cooperation with foreign telecommunication providers;
22. Minister refers to a Minister whose scope of tasks and responsibilities is in the field of telecommunication;
23. Director General refers to the Director General of Post and Telecommunication.
24. Directorate General refers to the Directorate General of Post and Telecommunication.

A high-level business executive’s comfortable life fell apart one day when his 19-year-old daughter accused him of having repeatedly molested her throughout her childhood. The executive lost his marriage as well as his $400.000-a-year job. But he fought back against the allegations, which he insisted were untrue. He sued his daughter therapists, who had assisted her in recovering these memories. A jury sided with the businessman, awarding him $500.000 in damages from the two therapists.



This case is but one of many involving adults who claim to have only recently become aware of memories of childhood sexual abuse. Hundreds of people throughout the country have been brought to trial on the basis of recovered memories of childhood abuse, with many of these cases resulting in convictions and long jail sentences, even in the absence of corroborating evidence. Such recovered memories often occur following suggestive probing by a therapist or hypnotist (Loftus, 1993). The issue of recovered memories continues to be hotly debated in psychology and the broader community. At the heart of the debate is the question, “Are recovered memories believable?” No one doubts that childhood sexual abuse is a major problem confronting our society. But should recovered memories be taken at face value?

Tak hanya kehilangan pekerjaannya, yang notabene dapat menghasikan $400.000 setahun, sang eksekutif pun kehilangan keluarganya. Namun, pria itu membantah dan melawan tuduhan tersebut. Dia menuntut kedua psikolog putrinya, yang telah membantu gadis itu mengingat kejadian tersebut. Dengan juri di pihaknya, dia pun memperoleh ganti rugi sebesar $500.000 dari para psikolog tersebut.

Kasus ini hanyalah satu dari sekian banyak kasus melibatkan orang-orang dewasa yang mengklaim dirinya baru saja mengingat kekerasan seksual yang dialaminya saat kecil. Di negara itu, ratusan orang telah diadili hanya dengan dasar pulihnya memori tentang kekerasan masa kecil. Meski tak ada bukti kuat yang dihadirkan, banyak dari kasus ini yang berakhir vonis dan hukuman kurungan yang lama. Pemulihan memori semacam ini seringkali dilakukan lewat penyelidikan sugestif oleh seorang psikolog atau pakar hipnotis (Loftus, 1993). Perihal memori yang terpulihkan terus menjadi perdebatan sengit baik dalam bidang psikologi maupun masyarakat luas. Di tengah-tengah perdebatan tersebut, muncul satu pertanyaan penting, “Dapatkah kita mempercayainya?” Tak pelak, kekerasan seksual masa kecil adalah satu masalah utama yang menghantui masyarakat. Namun, apakah kita lantas dapat begitu saja mempercayai memori yang terpulihkan?

My name is Prayudi Wijaya. I am a native Indonesian speaker with five years of experience as a professional full-time English-Indonesian (vice versa) certified translator. I have been in this industry since in 2009, starting out by providing translation services for some personal clients. Academically, I hold a Bachelor’s Degree in English Linguistics and a Master’s Degree in Linguistics, with Translation Studies as one of my academic interests. So, for me translation is not only a business, but also an art, a passion and hobby.
