Source text - English وحيث إن الوقائع – على ما يبين من الحكم المطعون فيه وسائر الأوراق – تتحصل في أن المطعون ضدها أقامت الدعوى 747 لسنة 2000 تجاري كلي أبوظبي اختصمت فيها الطاعنة ابتغاء الزامها بأن تؤدي إليها مبلغ -/4.696.833 درهماً، على سند من أن الطاعنة أسندت إليها تشييد بناية تجارية على الأرض العائدة لورثة........، وأنه وإذ تم توقيع عقد المقاولة وأودعت الكفالة المصرفية وحلَّ موعد صرف الدفعة المقدمة البالغة 25٪ من قيمة المقاولة في 10/5/1996م، فقد تأخرت الطاعنة في صرف تلك الدفعة حتى يوم 16/2/1997م، أي بتأخير دام (282) يوماً، الأمر الذي ترتب عليه أن تحملت غرامات تأخير قدرت بمبلغ -/1.876.000 درهم. فضلاً عن تأخر الطاعنة في تسليمها نسخة الأعمال الإضافية في ذات البناية الأمر الذي نجم عنه تأخير تنفيذ بعض بنود العقد الأصلي أسفر عنه إلحاق أضرار مادية وأدبية بها. ومحكمة أول درجة قضت في 26/2/2001م برفض الدعوى.
Translation - Arabic Whereas, in the facts - as apparent in the contested judgment and the documents - the respondent has filed the action no. 747 for 2000 commercial full bench Abu Dhabi, against the appellant, and requested to obligate the appellant to pay an amount of AED 4.696.833, referring to what has been said that the appellant has assigned the construction of commercial building on the land that returned to the successors of ………, and as the two parties have signed the contracting contract and the respondent has deposited banking guarantee and at the determined date of paying the advanced payment of 25% of the contracting contract value on 10-5-1996, the appellant has delayed to pay such payment till 16-2-1997 which is a delay of (282) days. Consequently, the respondent has incurred delay fines of AED 1.876.000. As well as the appellant delay to hand over the additional works copy of the same building which resulted the delay in executing some of the main contract items which lead to moral and material damages to the respondent. The Court of First Instance judged on 26-2-2001 to refuse the case.

The objective of this IT Policy Manual (hereinafter referred to as the “Manual”) shall be:
• To establish a framework for the IT activities of EDB (hereinafter referred to as the “Bank”) that recognizes industry leading practices and complies with laws and regulations applicable in UAE.
• It shall be intended that this Manual is used as a source of reference by all stakeholders involved in operating the Bank’s IT activities.
• This Manual will serve to provide guidelines to the Bank for its IT activity and to establish EDB’s IT evaluation standards.
• Also, this manual will enable the standardization of IT practices across the Bank.
• The purpose of the IT Policy is to:
o Be the primary means by which the Board of Directors guides the lending activities of the Bank;
o Clarify standards and state the Banks’s basic IT philosophy;
o Provide a framework for achieving asset quality and earning objectives;
o Provide a description of where the Bank wants to position itself on the IT spectrum.
• It shall be the responsibility of all concerned staff to ensure familiarity with and understanding of these guidelines, including subsequent amendment thereto, in order to maintain compliance with the requirements of the Manual at all times.
• Compliance with the IT Policy shall be to be monitored on a periodic basis by the Internal Audit Department, IT Department and Compliance Department.
• Act as a central reference guide to EDB management and employees with respect to day-to-day IT process.
