Source text - English AMMAN — A team of lawyers in Jordan might be willing to drop a criminal lawsuit they filed against YouTube’s owner Google for hosting the anti-Islam video “Innocence of Muslims”, if the company posts a public apology on their website, according to one of the lawyers.
“We want Google to carry a public apology on their website for one week,” said Adel Saqf El Hait, who filed the charges along with two other lawyers representing the Jordan Bar Association’s Freedom Committee.
“The apology should be one or two lines, and it should [acknowledge] that the company made a mistake,” he told The Jordan Times.
The lawsuit was filed in February.
However, Google wasn’t officially notified until mid-July, according to Thaer Najdawi, one of the lawyers from A&T Najdawi Law Firm, which represents Google.
The Amman Court of First Instance is currently reviewing the lawsuit and held its third hearing on the case last week.
The short video “Innocence of Muslims”, which depicts Prophet Mohammad as a greedy warrior and womaniser, sparked massive demonstrations across the Middle East after it was posted on YouTube last year.
Saqf El Hait argued that by hosting the video on YouTube, Google violated numerous Jordanian laws that prohibit insulting the messengers of God identified in the Koran.
Although Google is an American company and the video was produced in the United States, he said the lawsuit falls under Jordan’s jurisdiction because Google has access to the country’s Internet.
He cited a case that began in 2000, when Yahoo! Inc. was tried and convicted in France for violating French laws that prohibit the sale of Nazi memorabilia.
Saqf El Hait also explained that the charges against Google include violating Article 18 of the United Nations International Covenant on Civil and Political Rights, which states: “No one shall be subject to coercion which would impair his freedom to have or to adopt a religion or belief of his choice.”
The lawyer argued that the video constitutes hate-speech and thus, violated the right of Muslims to freely practise their religion.
“We’re not against freedom of speech,” Saqf El Hait said, noting that he was also involved in an ongoing lawsuit to expand press freedoms in Jordan.
“But we want Google to know that there is a difference between freedom of speech and hate-speech,” El Hait said.
Najdawi said the lawyers who filed the lawsuit “misunderstood” the concept of YouTube.
“The general public should understand that Google does not advocate for that film or its message,” he said.
Najdawi explained that Jordanian laws regarding slander are similar to US laws in that the prosecuting attorneys have to establish that the defendant committed the slander with “malicious intent”.
He explained that, unlike Yahoo, YouTube does not monitor the content of videos before they are posted on its website, pointing out that Google pulled the video from Jordan and other Middle Eastern countries after the film provoked outrage across the region.
Saqf El Hait said he intends to prove that Google knowingly allowed the video to be posted on YouTube and even “encouraged” the video to receive a lot of online attention.
“Even if you type ‘messenger Muhammad’ on Google, you will go directly to the video. They actually promoted the film,” he argued.
Saqf El Hait and the two other lawyers from the Jordan Bar Association’s freedom committee filed the same charges against the film’s producer, Nakoula Basseley Nakoula, who currently does not have a lawyer to represent him in the lawsuit.
Saqf El Hait noted that there were similar cases regarding “Innocence of Muslims” in several other countries, including Egypt and Pakistan.
“Our lawsuit is not a personal attack against Google; we use Google everyday,” he said.
“But they must respect the laws and customs of other nations just as we respect American laws and culture when we’re in the United States.”
Najdawi argued that YouTube should not be held responsible for the content of videos posted on its website in the same way that a phone service provider is not responsible for conversations about illegal activities that might occur on its network.
“In Arabic we have a saying that could be translated as: ‘If I were a messenger carrying a message of disbelief, I shouldn’t be prosecuted for that,’” Najdawi said.
This adage, he said, has a similar version in English: “Don’t kill the messenger.”

اعتذار الجوجل على الفيلم المسيء للإسلام قد يكون كافيا لإسقاط دعوى قضائية في الاردن – حسب المحامي
يريد المحامون من جوجل ان تنشر اعتذارا علنيا على موقعهم لندة اسبوع
عمان: قد يقبل فريق من المحامين في الاردن أن يسقطوا الدعوى القضائية الإجرامية التي رفعوها ضد مالك موقع اليوتيوب وهي شركة جوجل لاستضافتها للفيلم المسيء للإسلام " براءة المسلمين " وذلك في حال قامت الشركة بنشر اعتذار على موقعها حسب احد المحامين.
" نريد من الجوجل ان تنشر اعتذارا علنيا على موقعها لمدة اسبوع " هذا ما قاله المحامي عادل سقف الحيط , الذي بالإضافة لنقابة المحامين الأردنيين قد قام برفع الشكاوى وأضف قائلا للجوردن تايمز " يجب ان يكون الاعتذار من سطر او اثنين وأن يقرَّ بأن الشركة اقترفت خطأ."
مع انه قد تم رفع الدعوى القضائية في فبراير فانه لم يتم تبليغ الجوحل رسميا بذلك حتى منتصف يوليو حسب ثائر نجداوي أحد محامي شركة أحمد وثائر للمحاماة والتي تمثل الجوجل .
تقوم محكمة بداية عمان حاليا بمراجعة الدعوى القضائية وقامت بعقد جلسة الاستماع الثالثه لهذه القضية في الاسبوع الماضي .
الفيلم القصير " براءة المسلمين " الذي يصف الرسول محمد على انه محارب جشع وزير نساء قد اشعل مظاهرات كثيرة في الششرق الاوسط بعد ان تم عرضه على اليوتيوب في العام الماضي .
هذا وجادل سقف الحيط أنه بقيام اليوتيوب باستضافة هذا الفيلم فان شركة الجوجل تنتهك عددا من القوانين الاردنية التي تمنع اهانة رسل الله المذكورين في القران . و مع ان الجوجل شركة امريكية و أن الفيلم تم انتاجه في الولايات المتحدة الأمريكية فإن سقف الحيط يقول أن الدعوى القضائية تقع تحت السلطة القضائية الأردنية لأن الجوجل تملك امكانية الوصول لشبكة الانترنت في الاردن .
وقد استشهد بقضية بدأت عام 2000 عندما تمت محاكمة وإدانة شركة الياهو في فرنسا لانتهاكها قوانين فرنسية تمنع بيع تذكارات نازية .
وأيضا وضح سقف الحيط أن الشكاوى المرفوعة تشمل انتهاكها للمادة 18 من ميثاق الامم المتحدة العالمي فيما يتعلق بالحقوق السياسية والمدنية والذي ينص على " لا يجوز لأي أحد ان يخضع لإكراه من شأنه ان يخل بحريته في أن يعتنق او ان يكون له دين او اعتقاد من اختياره " ويجادل المحامي في ان الفيلم يتكون من خطاب كراهية وبالتالي ينتهك حق المسلمين في ان يمارسوا دينهم بحرية .
وقال سقف الحيط " نحن لسنا ضد حرية التعبير" مشيرا الى انه مشارك في دعوى قضائية جارية لتوسع نطاق حرية الصحافة في الاردن , مضيفا " لكننا نريد من الجوجل ان تعلم ان هنالك فرقا بين بين حرية التعبير وخطاب الكراهية."
بينما قال نجداوي بأن المحامين الذين قاموا برفع دعوى قضائية قد " اساءوا فهم " مفهوم اليوتيوب وأضاف " على العامة ان تفهم بأن الجوجل لا تؤيد الفيلم المسيء ولا الرسالة التي يحملها" وعلل قائلا بأن القوانين الاردنية التي تتعلق بتشويه السمعة مشابهه للقوانين الامريكية في ان على المحامين المدعين ان يثبتوا بأن المدعى عليه قد قام بالتشهير " بنية مغرضة " .
كما قال نجداوي بأنه على عكس الياهو فان اليوتيوب لا تقوم بمراقبة محتويات الفيديوهات قبل نشرها على موقعها مشيرا الى ان الجوجل قد قامت بسحب الفيديو من الأردن بالاضافة الى دول اخرى في الشرق الاوسط بعد أن أثار غضبا عارما في جميع انحاء المنطقة .
سقف الحيط بالإضافة الى محامين اثنين من لجنة الحرية لنقابة المحامين الأردنيين قاموا برفع نفس الشكاوى ضد منتج الفيلم نيكولا باسيلا نيكولا وحاليا لا يملك محاميا يمثله في الدعوى القضائية .
وأشار سقف الحيط بأنه كان هناك قضايا أخرى فيما يتعلق بفيلم " براءة المسلمين " في عدة دول أخرى بما فيها مصر وباكستان و أضاف " ان دعوانا القضائية ليست هجوما شخصيا على الجوجل فنحن نستخدم الجوجل كل يوم ولكن عليهم أن يحترموا قوانين و أعراف الأمم الأخرى كما نحترم القوانين والثقافة الأمريكية عندما نكون في الولايات المتحدة ."
وجادل نجداوي بأن اليوتيوب لا يجب ان يتحمل مسؤولية محتوى الفيديوهات التي يقوم بنشرها على موقعه تماما كما لا يتحمل مزود خدمة الهاتف مسؤولية المحادثات حول نشاطات غير قانونية قد تقع على شبكته .ويضيف قائلا أنه في اللغة العربية هنالك مقولة " اذا كنت رسولا أحمل رسالة كفر فلا يجب ان احاكم على ذلك " وهذا القول المأثور حسب قوله له أخر مرادف في اللغة الانجليزية و هو " لا تقتل الرسول " .
