Source text - Czech Protože ukládaný trest se pohybuje v rozmezí trestní sazby kvalifikované skutkové podstaty zločinu znásilnění podle ustanovení § 185 odst. 2 trestního zákoníku (sazba 2 - 10 let), je zřejmé, že takto uložený trest je, co do druhu uložené trestu, tak jeho samotné výměry – pokud soud porovná způsob provedení činu, osobu poškozené (mladá žena, charakterizovaná jako zvlášť zranitelná oběť) a s tím související důsledky jednání odsouzeného, včetně absence upřímné lítosti odsouzeného (v podrobnostech blížeji s odkazem na odůvodnění rozsudku na č.l. 14 až 16 spisu) – zcela slučitelný s právním řádem České republiky a nepřicházelo tak v úvahu jeho případné přizpůsobení.
Translation - English Since the sentence is within the statutory sentencing range for the aggravated felony of rape contrary to S 185 (2) Criminal Code (between 2–10 years), it is obvious that both in its nature and its length, the sentence is – when the Court compares the manner in which the act was carried out, the characteristics of the victim (young woman, described as a vulnerable victim) and thereto related consequences of the convicted person’s actions, including the convicted person’s lack of genuine remorse (for more details refer to sentencing remarks, case file, p. 14–16) – entirely consistent with the legal order of the Czech Republic, and any adjustment of the sentence was out of question.

Source text - English Part 3 — Duties, Powers and Liability of Representatives and Monitors
Duties of representatives
16
(1) A representative must
(a) act honestly and in good faith,
(b) exercise the care, diligence and skill of a reasonably prudent person, and
(c) act within the authority given in the representation agreement.
(2) When helping the adult to make decisions or when making decisions on behalf of the adult, a representative must
(a) consult, to the extent reasonable, with the adult to determine his or her current wishes, and
(b) comply with those wishes if it is reasonable to do so.
(2.1) Subsection (2) does not apply if
(a) a representative is acting within authority given to the representative under section 9, and
(b) the representation agreement provides that in exercising that authority the representative need only comply with any instructions or wishes the adult expressed while capable.
(3) If subsection (2) applies but the adult's current wishes cannot be determined or it is not reasonable to comply with them, the representative must comply with any instructions or wishes the adult expressed while capable.
(4) If the adult's instructions or expressed wishes are not known, the representative must act
(a) on the basis of the adult's known beliefs and values, or
(b) in the adult's best interests, if his or her beliefs and values are not known.
(5) On application by a representative, the court may exempt the representative from the duty under subsection (3) to comply with any instructions or wishes the adult expressed while he or she was capable.
(6) Subject to subsection (6.1), a representative may not delegate any authority given to the representative in the representation agreement.
(6.1) A representative may delegate to a qualified investment specialist, including a mutual fund manager, all or part of the representative's authority with respect to investment matters.
(7) If a representative makes health care decisions on behalf of an adult and the representative must, under subsection (4) (b) of this section, act in the adult's best interests, section 19 (3) of the Health Care (Consent) and Care Facility (Admission) Act applies.
(8) A representative must
(a) keep accounts and other records concerning the exercise of the representative's authority under the representation agreement, and
(b) produce the accounts and other records for inspection and copying at the request of any or all of the following:
(i) the adult;
(ii) the adult's monitor;
(iii) the Public Guardian and Trustee.
(9) A representative who is authorized to do anything referred to in section 7 (1) (b) must keep the adult's assets separate from the representative's assets.
(10) Unless the representation agreement provides otherwise, subsection (9) does not apply to assets that
(a) are owned by the adult and the representative as joint tenants, or
(b) have been substituted for, or derived from, assets that were owned by the adult and the representative as joint tenants.
(11) [Not in force. Repealed 2006-33-2.]
(12) A person who, on the death of an adult, will be or might be a beneficiary of the adult's estate does not, for that reason, have a conflict of interest with the adult.

Povinnosti reprezentantů
§ 16
1) Reprezentant musí
a) jednat poctivě a v dobré víře,
b) postupovat s péčí, svědomitostí a dovedností přiměřeně opatrné osoby a
c) jednat v rámci zmocnění, které mu uděluje dohoda o reprezentaci.
2) Když reprezentant pomáhá dospělému s rozhodováním nebo když rozhoduje za dospělého, musí reprezentant
a) s dospělým v rozumné míře konzultovat, aby zjistil jeho přání a
b) řídit se těmito přáními, je-li to rozumné.
2.1) Odstavec 2) se nepoužije,
a) jedná-li reprezentant v rámci zmocnění uděleného reprezentantovi podle paragrafu 9 a
b) stanoví-li dohoda o reprezentaci, že při vykonávání svého zmocnění je reprezentant povinen řídit se pouze instrukcemi nebo přáními, které dospělý vyjádřil, když byl způsobilý.
3) Použije-li se odstavec 2), ale nynější přání dospělého nelze zjistit nebo není rozumné se jimi řídit, musí se reprezentant řídit veškerými instrukcemi nebo přáními, které dospělý vyjádřil, když způsobilý byl.
4) Nejsou-li instrukce nebo projevená přání dospělého známa, musí reprezentant jednat
a) na základě přesvědčení a hodnot dospělého nebo
b) v nejlepším zájmu dospělého, pokud přesvědčení a hodnoty dospělého nejsou známé.
5) Na návrh reprezentanta může soud reprezentanta zprostit povinnosti uložené odstavcem 3) řídit se veškerými instrukcemi nebo přáními, které dospělý vyjádřil, když toho způsobilý byl.
6) Při splnění podmínek uvedených v odstavci 6.1) platí, že reprezentant nesmí delegovat žádné zmocnění udělené reprezentantovi v dohodě o reprezentaci.
6.1) Reprezentant může delegovat na kvalifikovaného investičního specialistu, včetně manažera družstevního fondu, celé nebo část zmocnění reprezentanta ohledně investičních záležitostí.
7) Učiní-li reprezentant za dospělého rozhodnutí o zdravotní péči, a musí-li podle odstavce 4) b) tohoto paragrafu jednat v nejlepším zájmu dospělého, použije se paragraf 19 odstavec 3) zákona o souhlasu se zdravotní péčí a o přijetí do pečovatelského zařízení.
8) Reprezentant musí
a) vést účty a další záznamy o výkonu zmocnění reprezentanta podle dohody o reprezentaci
b) předložit účty a další záznamy ke kontrole a vyhotovení kopií, kdy si to vyžádá kohokoli z následujících:
i) dospělý;
ii) monitor dospělého;
iii) veřejný opatrovník a správce.
9) Reprezentant zmocněný k čemukoli, co je uvedeno v paragrafu 7 odst. 1) b), musí vést majetek dospělého odděleně od svého majetku.
10) Nestanoví-li dohoda o reprezentaci jinak, odstavec 9) se nevztahuje na majetek, který
a) je spoluvlastnictvím dospělého a reprezentanta nebo
b) nahradil majetek nebo byl odvozen z majetku, který byl spoluvlastnictvím dospělého a reprezentanta.

12) Osoba, která po smrti dospělého bude nebo může být obmyšleným pozůstalosti dospělého, nemá jen proto s dospělým střet zájmů.
