Source text - Romanian Nu sunt de acord cu proiectul minier de la Roşia Montană. Din 2006, când la nivel public nu exista decât campania publicitară deşănţată a RMGC, m-am pronunţat public şi cu consecvenţă împotriva lui. Pentru mai multe motive. Raţionale şi obiective.
1. E absurd ca o ţară să accepte să renunţe la resursele sale, acceptând ca o companie privată să le exploateze, iar ţara să obţină doar nişte redevenţe de 2% sau de 6%. Un raport firesc ar fi ca statul, adică bugetul public, să obţină 70-80%. Altfel, ce interes ar avea?
2. O exploatare de asemenea anvergură cu cianuri nu mai există nicăieri în Europa şi, dacă nu mă înşel, abia dacă mai e una similară în lume. Ca şi cum România îşi rezolvase toate problemele şi doar cianura mai lipsea să o lăsăm moştenire generaţiilor viitoare. Nici în trecut şi nici în prezent compania minieră RMGC nu m-a convins că va avea forţa financiară, cu atât mai puţin interesul, de a reecologiza zona. E o companie creată strict pentru acest proiect, care va dispărea aşa cum a apărut: peste noapte.
3. Câtă vreme contractul nu este făcut public, pentru că RMGC se opune, nu avem cum să ştim dacă se va exploata doar aurul sau şi alte resurse în care zona este chiar mai bogată.
4. Siturile arheologice din zonă vor fi distruse. Ideea că le putem salva digital e o glumă nereuşită. Incapacitatea noastră de a le valorifica într-un proiect mai amplu, chiar cu o dimensiune turistică, pentru că infrastructura zonei este dezastruoasă şi pentru că nu gândim în termeni de dezvoltare durabilă, nu poate justifica distrugerea.
5. Mirajul locurilor de muncă îl înţeleg, dar este doar atât: un miraj. Crearea, chiar şi a 1.000 de locuri de muncă, doar pentru perioada exploatării (vreo 10 ani, căci după închiderea exploatării va fi doar un imens lac cu cianuri) nu poate justifica distrugerea. Multe din aceste locuri de muncă nici măcar nu vor fi pentru oamenii din zona, căci vor presupune înaltă specializare, ceea ce, local, nu există.
Mai am însă şi câteva argumente, la fel de puternice, chiar dacă ele sunt subiective sau emoţionale.
1. De la început acest proiect a demarat sub semnul manipulării, al discordiei, al înveninării vieţii locuitorilor din zonă. Bătaia de joc a aşa-zişilor investitori a fost năucitoare iar rezultatul a fost o comunitate divizată ireconciliabil.
2. Întreg proiectul s-a desfăşurat până acum cu imense probleme legale, multe legate de conflicte de interese. Nu cred că exista un alt proiect în legătură cu care justiţia din România să fi anulat atât de multe documente. Continuarea lui ar fi o legalizare a ilegalităţilor de până acum.
3. Am fost la Roşia Montană de mai multe ori. În ciuda dificultăţii de a ajunge acolo din cauza unei infrastructuri oribile şi în ciuda sărăciei zonei, ambele întreţinute special de companie de conivenţa cu diferitele autorităţi locale, odată ajuns acolo ţi se taie răsuflarea la vederea unei frumuseţi naturale unice în ţară. Flora zonei este unică în lume tocmai datorită resurselor naturale unice. Priveşti de jur împrejur şi simţi că te sufoci de revoltă la gândul că totul ar putea să devină un uriaş crater, şi nu din cauza unei catastrofe naturale, ci pentru că unii vor să distrugă pentru profitul lor personal imediat, iar noi, ceilalţi, nu ştim sau nu îndrăznim să apărăm ce avem.
Translation - English I don’t approve of the mining project in Rosia Montana . Since 2006, when the public was only privy to the despicable advertising campaign by RMGC, I publicly and consistently spoke out against it. For several reasons . Rational and objective reasons.
1 . It is absurd for a country to agree to give up its resources, condoning their exploitation by a private company, with the country receiving a measly 2% or 6% of the royalties. A normal state of affairs would be that the state, i.e. the public budget, get 70-80%. Otherwise what would be the point?
2 . An operation of this scale involving cyanide does not exist anywhere else in Europe and if I'm not mistaken, it barely exists anywhere else in the world. It is as if Romania had solved all of its problems and only cyanide was missing as a gift to future generations. Neither in the past nor in the present has the RMGC mining company convinced me that it has the financial strength, let alone the interest, to restore the natural habitat of the area. It is a company created solely for this project, which will disappear just as it appeared: overnight.
3. As long as the contract is not made public, due to RMGC’s opposition, we have no way of knowing if it will exploit only gold or other resources as well, resources that the area has even more of .
4. Archaeological sites in the area will be destroyed. The idea that we can store them digitally is a bad joke. Our inability to harness them into a larger project, with a touristic dimension even, because of faulty infrastructure and because we do not think in terms of sustainable development, cannot justify destruction.
5 . I understand the mirage of creating new jobs , but it's just that: a mirage. Creating even 1,000 jobs, only during operations (which will last about 10 years, because after that all that will be left is a huge lake of cyanide ) cannot justify destruction . Many of these jobs will not even go to the locals, as it will require highly specialized personnel, which, on a local level, does not exist.
I also dispose of some arguments that are equally strong, even though they may be subjective or emotional.
1 . From the very beginning, this project launched under the sign of manipulation, of contention, setting out to poison the life of the locals. The mockery of the so-called investors was bewildering and the result was a community irreconcilably divided.
2 . The entire project has encountered huge legal issues throughout, many related to conflicts of interest. I do not think there has been another project out there for which the Romanian justice system has had to cancel so many documents. Its continuation would be a legalization of the illegalities committed so far.
3 . I have visited Roşia Montana several times. Despite the difficulty in getting there due to horrendous infrastructure and despite the poverty of the area, both serving as reflections of various local authorities, once you are there, the natural beauty unique to the country is breathtaking. The local flora is single in the world precisely because of the unique natural resources . You look around and you feel suffocated by outrage at the thought that it could all become a huge crater, and not because of a natural disaster, but because some want to destroy it for immediate personal profit and the rest of us do not know or do not dare to defend what we have.

5. CONDITIONS OF SALE
5.1. [COMPANY] shall distribute and sell the PRODUCTS in the TERRITORY in its own name and for its own account. [COMPANY] shall observe that the PRODUCTS to be sold are in good condition.
5.2. [COMPANY] shall distribute and sell the PRODUCTS exclusively in the supplied packaging and presentation, without any addition or change, as delivered by ACME. Deviations to the supplied packaging shall only be allowed by prior written agreement from ACME.
6. WARRANTY AND LIABILITY
6.1. Any objection to the condition or quantity of PRODUCTS supplied must be made in writing promptly upon receipt but at the latest within one week of receipt, indicating item, invoice and delivery note number, otherwise the shipped goods will be regarded as accepted without opposition. If any objection proves justified, the PRODUCTS shall be replaced. The defective goods will become the property of ACME. If short shipments have been made, ACME may decide to furnish the missing quantity. Further claims are excluded.
6.2. ACME will only be responsible for product liability claims by third parties in accordance with the provisions of the laws in the TERRITORY.
6.3. [COMPANY] assumes all risk and liability for loss or damage to any person or property arising from mishandling or negligence in storing of any PRODUCTS by [COMPANY].
6.4. Prior to execution of this Agreement and on or before the anniversary date of each year thereafter, [COMPANY] shall provide to ACME and ACME shall provide [COMPANY] a certificate of insurance demonstration at least £1,000,000 per occurrence of product liability coverage.

Si la entrega resulta incompleta, ACME se reserva el derecho de suministrar la cantidad que falte. Se excluyen otras reclamaciones.
6.2. ACME sólo será responsable por reclamaciones de responsabilidad por productos por parte de terceros, de conformidad con la legislación vigente en el Territorio.
6.3. [Empresa] asume todo el riesgo y responsabilidad civil respecto a daños personales o materiales que surgirá por la manipulación incorrecta o la negligencia en el almacenamiento de los Productos de [Empresa].

8. Prohibitions
The Company shall not decompile or reverse engineer the Software. It will make any reasonable commercial effort to avoid any Trojan horse. It will not distribute any copy or reproduction of the Software, in accordance with Section 67 of Copyright Act.
9. Severability
Each provision of this Agreement or part thereof shall be severable.
10. Applicable Law and Jurisdiction
This Agreement shall be construed and governed by the laws of Spain, without regard to its conflict of law principles. Any dispute arising hereof shall be subject to the Courts of Barcelona. (...) The Parties will fulfil the court’s decision or, as the case may be, the arbitrator’s decision.

8. Interdicții

Prezentul Contract va fi interpretat și guvernat sub incidența legislației Spaniei, fără a se ține cont de conflictul de legi. Orice litigiu rezultat va fi supus instanțelor judecătorești din Barcelona. (...) Părțile vor îndeplini decizia instanței sau, după caz, decizia arbitrului.
DREPT CARE, Părțile convin să execute prezentul Contract începând cu data scrisă mai sus.
