يُعرِب مكتب المُدّعي العام لجمهورية لاتفيا عن احترامه لسلطات إنفاذ القانون في الإمارات العربية المتحدة، ونحن نتشرّف، بصفتنا سلطة قضائية مختصة في جمهورية لاتفيا، بالاتصال بكم بشأن المسائل المتعلّقة بالمساعدة القضائية المتبادَلة مع طلب تقديم الدّعم إلى سلطة إنفاذ القانون في لاتفيا فيما يخصّ التحقيق في إحدى الجرائم.
وتُجري إدارة الجريمة الاقتصادية التابعة للإدارة الرئيسية للشرطة الجنائية، وشرطة الدولة، ووزارة الداخلية في جمهورية لاتفيا تحقيقا في القضية الجنائية رقم 11816006119 المتعلّقة بجريمة مُحدّدة في الفقرة 3 من المادّة 195 من القانون الجنائي، والتي تتمثّل في غسل عائدات الجريمة على نطاق واسع. ولقد تقدّم "إينغا بريفلو"، كبير مُفتشي الوحدة الثانية التّابعة لإدارة مكافحة الجريمة الاقتصادية التابعة للإدارة المركزية للشرطة الجنائية، وشرطة الدولة، و وزارة الداخلية، بطلب للحصول على مساعدة قضائية، يعرِض فيه وقائع وتصنيف الجريمة ويُوضّح المساعدة المطلوبة.
ويسمحُ قانون الإجراءات الجنائية للشّخص الذي يوجّه الإجراءات بتقديم طلبٍ إلى سلطةٍ مختصة بشأن تنفيذ الأنشطة الإجرائية في دولة أجنبية، والتي ترسلها السلطة المختصة بعد ذلك إلى الدولة الأجنبية.
السّلطة المُختصّة
تُحدّد المادة 675 من قانون الإجراءات الجنائية اختصاص المدعي العام لجمهورية لاتفيا:
المادّة 675 - التّعاون بين السلطات المختصّة في المسائل الجنائية والقانونية
(1) تُرسل و تتلقّى السلطات المختصّة المنصوص عليها في القوانين واللوائح طلباتٍ للتعاون القضائي في المسائل الجنائية، وتنظم هذه المؤسسات التّعاون الدولي في المسائل الجنائية.
(2) قد تتّفق السّلطة المختصة في لاتفيا، في إطار التّعاون القضائي في المسائل الجنائية، مع سلطة أجنبية مختصة، بشأن الاتّصال المباشر بين المحاكم ومكاتب الادعاء العام ومؤسسات التحقيق.
(3) في حالة عدم وجود اتّفاق مع بلدٍ أجنبي بشأن التّعاون في مجال القانون الجنائي، يحقّ لوزير العدل والنائب العام، في نطاق الصلاحيات المحدَّدة في هذا الجزء من القانون، أن يُقدّما للبلد الأجنبي طلبا للتعاون في مجال القانون الجنائي إلى البلد الأجنبي، أو أن يتلقيا طلبا من البلد الأجنبي بشأن التعاون في المجال الجنائي و القانوني.
(4) يجوز للمسؤولين المُشار إليهم في الفقرة 3 من هذه المادّة أن يطلبوا أو يقدّموا إلى بلدٍ أجنبي تأكيدا بشأن مراعاة مبدأ المعاملة بالمثل في إطار التعاون القضائي الجنائي، أي أن شريك التّعاون سيقدم المساعدة أدناه، مع مراعاة المبادئ نفسها.
(5) يحقّ للسلطات المختصة في لاتفيا، في سياق التّعاون الجنائي ولقانوني، التّعاون مع أشخاص من "يوروجوست" (وحدة التعاون القضائي الأوروبي) والشبكة القضائية الأوروبية في المسائل الجنائية.

وفي إطار ممارسة حقوقي بموجب قانون الإجراءات الجنائية، أقدم إليكم طلب المساعدة القانونية المتبادلة في القضية الجنائية رقم 11816006119 وأدعوكم إلى اتّخاذ الخطوات اللازمة لتلبية هذا الطلب.
مبدأ المعاملة بالمثل
تتعهّد جمهورية لاتفيا، وِفقا لقوانينها ولوائحها، بالاستجابة لطلبٍ مستقبلي مماثلٍ من الإمارات العربية المتحدة إلى جمهورية لاتفيا.
بيانات إلزامية
نؤكد بموجب هذا الإشعار أن هذا الطلب:
(1) لا صلة له بالتّحقيق في شخصٍ ارتكب جريمة جنائية أو بمعاقبته، وهي جريمة سياسية أو تُعتبرُ كذلك بسبب ظروفها المحتمَلة؛
(2) لم يصدُر بغرض رفع دعوى جنائية ضد شخص بسبب عِرقِه أو معتقدِه الديني أو خلفيته الإثنية أو آرائه السياسية، أو بُغية معاقبته أو التّسبب له في أي ضرر على هذا الأساس؛
(3) لا صلة له بمقاضاة جنائية ضد شخص ما بسبب جريمة معيّنة أو جريمة أخرى ناجمة عن نفس الفعل أو الإغفال، ممّا يشكّل جريمة مُعيّنة سبق لمحكمة مختصة أو مؤسسة أخرى في جمهورية لاتفيا أن أدانت بسببها هذا الشّخص أو برّأته أو عفت عنه.
ونشهد بموجب هذا، بأنّ جميع المعلومات والوثائق وغيرها من الأدلة التي تقدّمها السلطات المختصة في الإمارات العربية المتحدة إلى جمهورية لاتفيا لن تُستخدم إلا في سياق الإجراءات الجنائية المُحدّدة أعلاه...
كما نشهد بموجب هذا أيضا، بأن تنفيذ هذا الطلب ممكن في جمهورية لاتفيا وفقا للقوانين السّارية.

On the request for legal assistance in criminal proceedings No 11816006119
The Office of the Prosecutor-General of the Republic of Latvia expresses its respect to the law enforcement authorities of the United Arab Emirates, and we, as a competent judicial authority of the Republic of Latvia have the honour to contact you on the matters of mutual judicial assistance with a request to support a Latvian law enforcement authority in its investigation of a crime.
The Economic Crime Enforcement Department of the Chief Criminal Police Administration, State Police, Ministry of the Interior of the Republic of Latvia, conducts an investigation in criminal case No 11816006119 related to a crime defined in Section 195, Paragraph 3 of the Criminal Law, namely, the laundering of proceeds from crime on a large scale. Inga Brīvule, Senior Inspector of the Second Unit of the Economic Crime Enforcement Department of the Chief Criminal Police Administration, State Police, Ministry of the Interior, has issued a Request for Judicial Assistance outlining the facts and classification of the criminal offence, describing the required assistance.
The Criminal Procedure Law allows the person directing the proceedings to submit a request to a competent authority regarding the performance of procedural activities in a foreign state, which that competent authority then sends to the foreign state.
Competent Authority
The competence of the Prosecutor General of the Republic of Latvia is determined in Section 675 of the Criminal Procedure Law:
Section 675. Criminal-legal Co-operation in Competent Authorities
(1) The competent authorities that are specified in laws and regulations shall send and receive requests for criminal-legal co-operation, and such institutions shall regulate international co-operation in criminal matters.
(2) A Latvian competent authority may agree, in criminal-legal co-operation, with a foreign competent authority regarding the direct communication between courts, Prosecutor’s Offices, and investigating institutions.
(3) If an agreement with a foreign country regarding criminal-legal co-operation does not exist, the Minister for Justice and the Prosecutor General have the right, within the framework of the competence specified in this Part of this Law, to submit to the foreign country a request for criminal-legal co-operation, or to receive a request from the foreign country for criminal-legal co-operation.
(4) The officials referred to in Paragraph three of this Section may request from, or submit to, a foreign country a confirmation that reciprocity will be observed in criminal-legal co-operation, that is, that the co-operation partner will hereinafter provide assistance, observing the same principles.
(5) Latvian competent authorities are entitled, in criminal-legal co-operation, to co-operate with contact persons of Eurojust (European Judicial Cooperation Unit) and the European Judicial Network in Criminal Matters.

Exercising the rights vested in me by the Criminal Procedure Law, I hereby submit to you the Request for Judicial Assistance in criminal case No 11816006119 and ask you to arrange the fulfilment of this request.
Principle of reciprocity
In accordance with its laws and regulations, the Republic of Latvia undertakes to fulfil a future request of similar nature issued by the United Arab Emirates to the Republic of Latvia.
Mandatory statements
We hereby confirm that this request:
a) is not related to an investigation or punishment in relation to a person who committed a criminal offence, which is a political crime or is deemed as such due to its possible circumstances;
b) has not been issued with the aim to carry out criminal prosecution against a person due to his or her race, religious beliefs, ethnic background or political views, or to punish such a person, or to cause any harm to this person on such grounds;
c) is not related to criminal prosecution against a person due to any particular offence or other offence arising from the same act or omission, which constitutes that particular offence, for which a competent court or other institution of the Republic of Latvia has already convicted, acquitted or pardoned this person.
We hereby certify that the entire information, documents and other evidence provided by the competent authorities of the United Arab Emirates to the Republic of Latvia, will only be used within the criminal proceedings specified above.
We hereby certify that the fulfilment of this request is possible in the Republic of Latvia in accordance with applicable laws.

ON HOLDING A PERSON CRIMINALLY LIABLE
(INDICTMENT)

Having examined materials of the criminal case No. 11822000419, Alla Latiškeviča, Public Prosecutor of Balvi District Public Prosecutor's Office,
established:
The evidence collected during investigation indicates that Dilbag Singh, date of birth: 10 April 1979, citizen of the Republic of India, knowingly and illegally crossed the state's external border in a group of persons under the following circumstances: on 26 July 2019, at a time, which was not ascertained more precisely during the pre-trial investigation, Dilbag Singh, being aware that he did not hold permission of the relevant institutions to enter the Republic of Latvia from the Russian Federation, violating the requirements of Section 4 of the Immigration Law and Section 10, Clause 2 and Clause 4 of the Law On the State Border of the Republic of Latvia, which stipulate that a foreigner is entitled to enter and reside in the Republic of Latvia, if he or she concurrently has a valid travel document or residence permit, or a residence permit of a long-term resident of the European Community, and that the State border shall be crossed by road or railway, in a group with Sunil Kumar and two more persons, the criminal proceedings against whom have been separated as a separate record, in the territory controlled by the State Border Guard Viļaka Department, at Viļaka Municipality, Žīguri Parish, in the vicinity of non-residential area “Sazanova”, near the border sign No. 483, at the place, which was not intended for the crossing of border, bypassing the border crossing points, knowingly and illegally crossed the external state border of the Republic of Latvia in the direction from the Russian Federation to the Republic of Latvia. On 27 July 2019 at 7:40, Dilbag Singh was detained in the Republic of Latvia, at Madona Municipality.
By his actions Dilbag Singh committed the criminal offence – a less serious crime provided for in Section 284, Paragraph Two of the Criminal Law.
On the basis of the aforementioned and in accordance with Section 402, Section 403, Paragraph One, Clause 1, and Section 405 of the Criminal Procedure Law,
decided:
1 To hold Dilbag Singh, date of birth: 10 April 1979, criminally liable in commission of the criminal offence provided for in Section 284, Paragraph Two of the Criminal Law
2 To issue a copy of the indictment to Dilbag Singh in accordance with the procedures laid down in Section 406 of the Criminal Procedure Law.
The decision shall not be subject to appeal.
