If, in accordance with clause 14.10(b), the Project Company: (a) achieves the Phase Two Power Milestone; but
(b) the Demonstrated Power Capacity, in respect of the Phase Two Power Units, is less than the Guaranteed Contracted Phase Two Power Capacity but equal to or more
than the Minimum Phase Two Power Capacity,

then the Project Company shall pay the Buyer liquidated damages at the rate of six hundred Rial Omani (R.O. 600) per MW of Shortfall for each Day from achievement of the Phase Two Power Milestone up to up to the earlier in time of:

(c) an Additional Performance Test carried out and Duly Completed in accordance with clauses 14.12 and 14.13; and

(d) the day preceding the Scheduled Commercial Operation Date,

in which event the relevant Demonstrated Power Capacity shall be as demonstrated by such
Additional Performance Test or the Plant Acceptance Test (as applicable).

8.7 If, in accordance with clause 14.17(b), the Project Company: (a) achieves the Phase Two Water Milestone; but
(b) the Demonstrated Water Capacity, in respect of the Phase Two Desalination Units, is less than the Guaranteed Contracted Phase Two Water Capacity but equal to or more than the Minimum Phase Two Water Capacity,

then the Project Company shall pay the Buyer liquidated damages at the rate of thirteen Rial Omani (R.O. 13) per m3/h of Shortfall for each Day from achievement of the Phase Two Water Milestone up to the earlier in time of:

(c) an Additional Performance Test carried out and Duly Completed in accordance with clauses 14.19 and 14.20; and

(d) the day preceding the Scheduled Commercial Operation Date,

in which event the relevant Demonstrated Power Capacity shall be as demonstrated by such
Additional Performance Test or the Plant Acceptance Test (as applicable).

8.8 The Project Company shall pay any liquidated damages due pursuant to clauses 8.3 , 8.4, 8.5,
8.6 and 8.7 in respect of any Calendar Month, within seven (7) Days of the start of the following Calendar Month. The Buyer shall have the right to set-off or deduct any such
liquidated damages from any amounts due and arising by the Buyer to the Project Company.

8.9 The Project Company shall comply with the Construction Programme and shall notify the
Buyer of any failure to do so, which notice shall identify: (a) the nature of the failure;
(b) the reason for the failure;

(c) the impact which such failure has had, or in the reasonable opinion of the Project
Company (acting as a Reasonable and Prudent Operator), is likely to have or will have, on its ability to achieve any of the Milestones on the Scheduled Dates for the same
which are specified in the Construction Programme; and

(d) the steps which the Project Company (acting as a Reasonable and Prudent Operator)
has taken, is taking and will take to mitigate the adverse consequences of such failure.

8.10 If the Project Company is unable to achieve a Milestone due to a Buyer Failure, a Buyer Risk
Event or a Force Majeure Event:

(a) the Project Company shall, to the extent that its failure to achieve such a Milestone by the Scheduled Date for the same is caused by such Buyer Failure, Buyer Risk Event
or Force Majeure Event, be relieved of any liability in respect of such failure;

(b) the Scheduled Dates shall (save where clause 15 applies) be deferred by a period of time equal to the period of unavoidable delay to the progress of Construction caused
by the Buyer Failure and/or Force Majeure Event and/or Buyer Risk Event;


9 Seawater Intake/Outfall Facilities

The Project Company shall Construct the Seawater Intake/Outfall Facilities and shall operate and maintain the same in accordance with Good Practice throughout the Term.


10 Project Company's Obligations during the Construction Period

10.1 In addition to the obligations specified elsewhere in this Agreement, the Project Company shall
be obliged during the Construction Period to:

(a) Construct the Plant (including the Seawater Intake/Outfall Facilities) and the Access Road in strict compliance with Schedule F save to the extent that the Buyer's prior written approval of any deviation there from has been obtained;

(b) utilise, in the Construction of the Plant (including the Seawater Intake/Outfall Facilities) and the Access Road, an Omani Content of a level equal to or greater than the Contracted Omani Content;

(c) procure all plant and components required for the Project;

(d) subject to clauses 11.1(a) and 11.1(b), obtain and pay for all Fuel and/or Electrical Energy Import and all other utilities required by the Project Company to perform its obligations during the Construction Period;

(e) arrange finance to enable it to perform its obligations in relation to the Project;

(f) carry out the Construction of the Plant (including the Seawater Intake/Outfall Facilities)
and the Access Road to the standard of a Reasonable and Prudent Operator, in a
safe manner, in accordance with Good Practice and in compliance with the Law and this Agreement;

(g) comply with the Generation and Desalination Licence; and

(h) comply with the System Code.

9 海水进/出设施

项目公司应建造海水进/出设施,并应采取良好做法在合同期间进行相应的运行和维护。


10 建造阶段项目公司的责任

10.1 除了本协议另外规定的责任以外,建造阶段项目公司还应有下列责任:

(a) 严格按照F计划建造工厂(包括海水进/出设施)和通路,除非事先获得买方关于变动的书面许可;

(b) 在建造工厂(包括海水进/出设施)和通路过程中,采用与合同规定的阿曼标准相等或更高的阿曼标准。;

(c) 为本项目采购所有必需的工厂设施和组件;

(d) 根据第11.1(a)条和第11.1(b)条,对于在项目期间,获取并支付项目公司用于履行职责所需要的一切燃料和/或输入电能以及一切其它设施;

(e) 进行财务方面的安排,以保证能够履行本项目相关责任;

(f) 进行工厂(包括海水进/出设施)和通路建造,以合理且审慎运行方的标准,采用安全的方式,且遵照法律和本协议。

Built for an elderly Navajo couple, the homesite is rural, high desert. Extreme temperature swings, severe winds, and respect for sacred land (minimum disruption) were design criteria. Rejected road base forms the walls-hand-made bricks-perfect for thermal mass. Left exposed, the bricks catch passive solar heat. A river rock trombe wall runs the length of the southern wall, also providing solar heat. A solar roof water heating system serves as back-up for a donated radiant floor heating system (never needed so far). Not only did we not send anything to the landfill, reusing all foundation forming materials, but rather we took materials out of the landfill: un-galvanized corrugated metal and rusted mesh found in the local gravel pit/dump made exterior casing and soffit; hundreds of old tires built a retention wall; various discarded pipes and metal pieces served as supportive interior columns. The result is a low-tech, comfortable, much-loved home.

4.2.3 Process Flow Diagrams and Process Description
The process flow diagrams (PFDs) should show the process flow scheme with all process streams, process equipment, main utility streams and process control philosophy. The following information will be shown on the process flow diagram:
• Item number and service name of all major equipment
• Basic control loops necessary for controlling the process
• Stream numbers for major process streams corresponding with the heat and mass balance
• Source of incoming and destination of outgoing streams
A detailed process description of all the process flow diagrams (”PFD”) should be provided explaining the function of major process equipment. The major constraints, including potential contaminants and their limits, for processing the syngas will be indicated.
Operating procedures should describe all phases of unit operations, including: normal operation, start-up, shutdown and emergency procedures (unit and utilities related). Descriptions should be to the detail required to understand the main control philosophy and to allow an experienced engineering contractor to carry out the detailed engineering work for the unit.
4.2.4 Heat and Mass Balances
Mass and heat balances for the process design feedstock(s) should show the following:
• Stream number (corresponding with PFDs)
• Name and phase of fluid (phases of two phase streams will be shown separately)

ISSUE OF SHARES
4. Without prejudice to any special rights previously conferred on the holders of any existing shares or class of shares but subject to the Act, shares in the Company may be issued by the directors and any such share may be issued with such preferred, deferred, or other special rights or such restrictions, whether in regard to dividend, voting, return of capital, or otherwise, as the directors subject to any ordinary resolution of the Company, determine.

Submittals and approval
At least 56 days before any application, basing on the approved technical design document and this present specifications, the Contractor shall submit detail drawings and methods proposed for the installation, fabrication of instrumentation for approval by Engineer. In the case of automatic instrumentation to be purchased from abroad, the Contractor is expected to prepared drawings showing arrangement and Specifications for equipment procurement for agreement by Engineer before procurement bidding. The Engineer shall be informed about the awarded Supplier of instrumentation and he shall have the right to deny if he found that the to be supplied instrumentation failed from meeting the agreed specifications of such instrumentation.
The Contractor shall submitted for approval by Engineer the lists of qualified employees proposed for the installation and supervision of work at least 28 days before any application at the site.
The Contractor shall submit at least 03 copies of guidance, manual book in Vietnamese and English for measurement and maintenance of equipment.
The Engineer reserves the right to request from the Contractor additional documents as may be required for proper understanding and definition of construction and operation.
All documents to be supplied shall be submitted in time so that any comment and change requested by the Engineer can be taken into account before any fabrication and procurement . Any proposed deviation from the drawings shall be brought to the attention of the Engineer when drawings are submitted by the Contractor for review
The Contractor shall be responsible for all inconsistency, errors or mistakes in drawings and documents submitted by the Contractor, even when they have been approved by the Engineer. The approval of such drawings and documents submitted by the Contractor shall not relieve the Contractor's responsibilities from the Contract obligations.
Each details, device appearing on any document (drawings, diagrams, lists, etc.) shall be clearly designated. The abbreviation mark used for an individual device shall be identical throughout the complete documentation so as to avoid confusion. All documents shall have a uniform title-block as agreed by Engineer.
Revised technical documents superseding previously submitted documents shall be marked accordingly. Furthermore, the revised parts in the document itself shall be marked clearly.

Profile:
Over sixteen years of experience as a technical translator and interpreter having translated more than 15 million words in technical fields such as nuclear power and renewable energies, the chemical and pharmaceutical industry as well as in the shipbuilding and oil industry. I started to interpret for GMP audits since 2011, cooperating with European independent GMP auditors (We’ve carried out more than 100 audits of major pharmaceutical plants and labs around China), including FDA audit. I have translated a wide range of documents such as reports for the World Association of Nuclear Operators (WANO), the Institute of Nuclear Power Operations (INPO) and the Electric Power Research Institute (EPRI), as well as Standard Operating Procedures (SOPs) of Chinese nuclear power plants, Advanced Information Packages (AIPs), Area for Improvements reports (AFI) and Design-Informed Review reports (DIR). Through my work as a translator and interpreter for the WANO and the Electric Power Research Institute (EPRI), I have had the chance to visit almost all nuclear power plants in China.
 
For technical areas other than nuclear, I also worked as interpreter and translator for Mitsui & Co, I translated for the Chinese technicians involved in the construction of a chemical plant, including civil work, equipment erection, pipeline arrangement, overall commissioning and lab test. The duration of the project was of 2 years (2008-2010) in which I traveled 7 times to India for this project. Furthermore, in 2014 I was the technical interpreter for the Peer Review carried out by the WANO to the China National Nuclear Power Corporation (CNNP). During that period, we visited and reviewed the Fuqing Nuclear Power Plant and the CNNP headquarter.

I. Introduction

1. I started working as translator and interpreter since 2003 when I was still in the junior year of Qingdao University. I have passed TEM-8 Test, top-level English examination in China. I also hold The Shanghai Advanced-level English Interpretation Post Credentials Certificate, which is the vocational certificate for interpreters. In September, 2019, I was recruited by Yunnan Agricultural University this year for the MTI (Master of Translation
and Interpretation) program on a part-time basis.

2. After graduation from university, I have worked overseas in Malaysia (bio- fertilizer project translator & interpreter) and India (Mitsui & Co chemical project translator and interpreter). respectively for 1 year and 2 years. And I have worked as technical translator for 2 years for French royal paper mill – Arjo Wiggins Specialty Paper project in China. In shanghai, I work as freelance translator and interpreter, and I have translated documents and worked as interpreter for various large multi-national enterprises, like Ericsson, Johnson Controls, Caterpillar, Volkswagen, Bosch, Siemens, BASF, CIBA, and SGS etc. Currently, until 20th, Dec, 2014, I am working on the project of CNOOC (China National Offshore Oil Corporation) Huizhou Refinery Project, with American service provider UOP (Universal Oil Products LLC.).
