Selamat Pagi dan Salam Sejahtera untuk kita semua.
Mengawali sambutan ini saya mengajak hadirin sekalian untuk senantiasa memanjatkan puji syukur ke hadirat Allah SWT, karena berkat rahmat dan karunia-Nya kita masih diberi kesempatan, kekuatan, dan kesehatan untuk hadir dalam acara “Sosialisasi Kebijakan Pengaturan Dan Pengawasan Badan Usaha Jasa Konstruksi Asing (BUJKA) Di Indonesia” pada pagi hari ini.
Semoga kegiatan sosialisasi ini dapat memberikan manfaat bagi kita semua berupa pemahaman dan persepsi yang sama dan lebih baik terhadap peraturan perundangan yang terkait dengan tertib perizinan Badan Usaha Jasa Konstruksi Asing atau BUJKA di Indonesia.
Hadirin Sekalian Yang Berbahagia,
Seperti kita ketahui bersama, pertumbuhan pasar usaha jasa konstruksi ke depan akan semakin cerah, sebagai dampak positif dari tingginya tingkat pertumbuhan perekonomian nasional. Hal tersebut akan semakin menjanjikan lagi, mengingat kecenderungan peningkatan permintaan yang sangat signifikan sebagai konsekuensi dari percepatan dan perluasan pembangunan infrastruktur di seluruh wilayah tanah air, sebagaimana diprioritaskan dalam program MP3EI 2011-2025.
Pertumbuhan pasar jasa konstruksi nasional tersebut, menjadi pemicu bagi pelaku jasa konstruksi asing untuk berpartisipasi pada kegiatan konstruksi di Indonesia. Sebagai ilustrasi, pada tahun 2010 tercatat 207 BUJKA yang memiliki Izin Perwakilan di Indonesia, sejak program MP3EI di launching oleh Pemerintah Indonesia pada tahun 2011, jumlah BUJKA tersebut meningkat 45% ditahun 2013 menjadi sebanyak 302 BUJKA. Data-data tersebut membuktikan bahwa Indonesia merupakan suatu pasar jasa konstruksi yang sangat menjanjikan bagi para pelaku jasa konstruksi asing.
Hadirin sekalian yang berbahagia,
Saya perlu tegaskan bahwa Pemerintah Indonesia tidak pernah mengganggap kehadiran para pelaku jasa konstruksi asing di Indonesia menjadi suatu ancaman bagi jasa konstruksi nasional. Karena kami menyadari bahwa Indonesia merupakan bagian yang tidak terpisahkan dari perekonomian dan persaingan global. Lebih dari itu, kami justru melihat kehadiran pelaku jasa konstruksi asing sebagai suatu peluang untuk meningkatkan kemampuan dan penguasaan teknologi para pelaku jasa konstruksi nasional.
Disisi lain, saya perlu ingatkan bahwa Pemerintah Indonesia memiliki kewajiban untuk melindungi kepentingan masyarakat dari produk konstruksi yang dihasilkan oleh para pelaku jasa konstruksi asing yang terlibat dalam kegiatan konstruksi di Indonesia. Oleh sebab itu, saya menegaskan kepada seluruh perwakilan BUJKA yang hadir disini, agar dalam melakukan kegiatan pekerjaan konstruksi di Indonesia senantiasa mentaati koridor hukum yang berlaku di Indonesia.
Khusus bagi para pengguna jasa BUJKA yang hadir disini, saya ingin mengingatkan dalam penyelenggaraan jasa konstruksi yang melibatkan pelaku jasa konstruksi asing, merupakan kewajiban anda untuk memastikan bahwa BUJKA yang menjadi penyedia jasa dilingkungan anda adalah BUJKA yang patuh terhadap peraturan perundangan di Indonesia.
Hadirin sekalian yang berbahagia,
Pada kesempatan ini saya ingin menggaris bawahi 4 substansi kewajiban penting dalam Peraturan Menteri Pekerjaan Umum Nomor 05 Tahun 2011 Tentang Pedoman Persyaratan Pemberian Izin Perwakilan Badan Usaha Jasa Konstruksi Asing, yang perlu menjadi perhatian Bapak-Ibu sekalian, yakni:
1. Kewajiban BUJKA untuk melakukan Kerjasama Operasi atau Joint Operation dengan BUJK Nasional yang setara dalam setiap kegiatan jasa konstruksi di Indonesia.
2. Kewajiban untuk mempekerjakan tenaga kerja Indonesia sebagai pendamping tenaga kerja warga negara asing pada tingkat manajemen dan teknis.
3. Kewajiban untuk melaksanakan alih pengetahuan (transfer of knowledge) kepada BUJK sebagai mitra kerjasama operasi.
4. Kewajiban untuk menyampaikan laporan kegiatan tahunan kepada Badan Pembinaan Konstruksi.
Dari hasil kegiatan monitoring dan evaluasi yang dilakukan oleh Badan Pembinaan Konstruksi, keempat substansi tersebut merupakan kewajiban yang relatif sering belum dipenuhi oleh BUJKA. Oleh sebab itu, saya ingatkan bahwa kedepan Pemerintah akan lebih tegas dalam memberikan sanksi kepada setiap pelanggaran yang dilakukan oleh BUJKA tersebut.
Hadirin Sekalian Yang Berbahagia,
Demikian beberapa hal yang dapat saya sampaikan, sekali lagi saya berharap, dengan dilaksanakannya sosialisasi ini dapat meningkatkan pemahaman para perwakilan BUJKA, pengguna jasa, serta seluruh pemangku kepentingan yang hadir disini. Dengan demikian, dapat menjadi langkah awal untuk terciptanya tertib perizinan jasa konstruksi sesuai dengan amanat Undang-Undang Nomor 18 Tahun 1999 tentang Jasa Konstruksi.
Saya juga menyampaikan terimakasih atas kesediaan saudara untuk memenuhi undangan ini, khususnya para narasumber yang akan menyampaikan materi pada kegiatan ini. Harapan saya, semoga acara sosialisasi ini dapat berjalan dengan lancar, sehingga manfaat kehadiran BUJKA dapat betul-betul dirasakan secara maksimal oleh pelaku jasa konstruksi nasional.

Good Morning and Best Wishes to all of us.
Starting of this speech I would like to invite ladies and gentlemen to say thanks to God, through his grace and gift we are still been given chance, strength and health to attend the "Socialisation Policy Setting And Supervision Entity of Foreign Construction Service (BUJKA) In Indonesia" this morning.
May this social event gave the benefit to us in form of the same understanding and even much better in laws and regulations related to the licensing discipline of Entity of Foreign Construction Services or BUJKA in Indonesia.
The Blessed Ladies and Gentlemen
As we all know, the future market growth in construction business services will be brighter, as the positive impact of the increase of national economic growth. It will be more promising, given the tendency of a very significant increase in demand as a consequence of acceleration and infrastructure expansion in all regions, as it is prioritize in MP3EI 2011-2-2025 program.
The growth of construction service market become a trigger for the foreign construction service to participate in the construction event in Indonesia. As an illustration, in 2010 there is 207 BUJKA that own the Representatives License in Indonesia, since the MP3EI program was launched by the Indonesian government in 2011, the number of BUJKA was 45% increased in 2013 as many as 302 BUJKA. Those data proves that Indonesia is one of the promising construction services market for the performer of foreign construction service market
The Blessed Ladies and Gentlemen,
I Need to be Emphasized that Indonesian Government never considers the presence of foreign service provider of construction services in Indonesia to be a threat to national construction services. Because we realized that Indonesia is part of unseparated from economic and global competition. More of it, we saw the presence of foreign construction services provider as an opportunity to enhance the technology capabilities and command of national service provider.
On the other hand, I need to remind that Indonesian Government have an obligation to protect citizen interest from construction product produced by foreign construction service provider involved in construction activities in Indonesia. Therefore, I made it clear to all BUJKA representatives who are present today, in order to carry on construction activities in Indonesia to always comply the Indonesian law
Especially for BUJKA service user who are present today, I would like to remind the organizer of construction service involving foreign construction service provider, is part of your obligation to ensure that BUJKA will become service provider in your society is the BUJKA that submit to the law and regulation in Indonesia.
The Blessed Ladies and Gentlemen,
In this opportunity I would like to underscore 4 important obligation substances in the Regulation of Ministry of Public Work Number 05 year 2011 Concerning the Guidelines of License Requirement for Representatives of Foreign Entity Construction Services, that needs your attention, namely:
1. BUJKA obligation to conduct Joint Operation with BUJKA National equivalant in any construction activity in Indonesia.
2. The obligation to employ local worker as counterpart to foreign worker in management and technical level.
3. The obligation to transfer of knowledge to BUJKA as as a collaboration.
4. The obligation to submit an annual report activities to Construction Development Board
The result from monitoring and evaluation activities conducted by the Construction Development Board, those fourth substances is a relatively frequent obligations that have not been met by BUJKA. Therefore, let me remind you that in future Government will be more assertive in giving the sanction to any offence committed by BUJKA.

Thus are the things that I can convey, once again I look forward, with the socialisation implementation may enhance the understanding of BUJKA representatives, service provider, and all stakeholder present here. Thereby, it will be a first step the forming of construction licensing discipline in accordance with the Law mandate Number 18 year 1999 about construction services.
I express my gratitude for your willingness to meet this invitation, especially to the distinguish guest whom will soon delivering the material in this event. I hope, this socialisation event may be running smoothly, so the BUJKA presence truly perceived by the national service provider.
