Source text - Czech Program Interreg IIIA byl vletech 2004 až 2006 součástí Iniciativy Společenství Interreg III, o jejímž vzniku rozhodla Evropská komise 28. dubna 2000 a jejímž obecným cílem bylo, aby hranice jednotlivých států nebyly překážkou vyváženého rozvoje a integrace evropského území. Iniciativa měla tři části, kde část A byla zaměřena na přeshraniční spolupráci, do níž se Česká republika zapojila v roce 2004 pomocí pěti programů pro příhraničí s Německem (Saskem a Bavorskem), Rakouskem, Slovenskem a Polskem.
Interreg IIIA byl financován v rámci strukturálních fondů z Evropského fondu pro regionální rozvoj (dále jen „ERDF") a řídil se příslušnými normami vydanými orgány Evropské unie, zejména:
- Nařízením Rady (ES) č. 1260/1999 ze dne 21. června 1999 o obecných ustanoveních o
strukturálních fondech;
- Nařízením Evropského Parlamentu a Rady (ES) č. 1783/1999 ze dne 12. července
1999 o Evropském fondu pro regionální rozvoj;
- Sdělením Komise členským státům ze dne 2. září 2004, kterým se stanoví obecné
zásady pro iniciativu Společenství týkající se celoevropské spolupráce s cílem
podporovat harmonický a vyvážený rozvoj evropského území Interreg III
(2004/C226/02) - dále jen „Zásady Interreg".
Na národní úrovni se program řídil pravidly platnými pro financování programů ze státního rozpočtu, zejména zákonem č. 218/2000 Sb., rozpočtová pravidla a vyhláškou č. 40/2001 Sb., ve znění pozdějších předpisů.
1. Programové řízení
Základními programovými dokumenty byly Programy Iniciativy Společenství (Community Initiative Programme - dále jen „CÍP"), které zpracovalo MMR společně s příslušným zahraničním partnerem pro každé příhraničí, tj. pro Sasko, Bavorsko, Rakousko, Polsko a Slovensko pro období 2004 až 2006. CÍP pro Německo (Sasko, Bavorsko) a Rakousko vznikly přepracováním původních programových dokumentů, na základě nichž tyto státy čerpaly pomoc ze strukturálních fondů v období před vstupem České republiky do Evropské unie.
1.1 Všechny CÍP byly schváleny usnesením vlády z 5. května 2004 č. 432 a následně
Evropskou komisí (příloha č. 14). První verze CÍP byly Evropské komisi předloženy řídícím
orgánem (u Polska bylo řídícím orgánem MMR, jak bude dále uvedeno) v období srpna 2003
až února 2004. Evropskou komisí byly schváleny v říjnu až listopadu 2004 a v průběhu
programového období byly upravovány do podoby druhé případně třetí verze.
CÍP obsahovaly sociálně-ekonomickou analýzu příslušného příhraničí, stručný popis cílů, priorit a opatření programu, způsob jejich realizace, hodnocení, financování a implementace, což MMR podrobněji rozvedlo v programových dodatcích, které předložilo u programu spolupráce s Polskem Evropské komisi na vědomí (u ostatních programů byly programové dodatky předloženy příslušným řídícím orgánem). Kromě toho MMR zpracovalo pro každé příhraničí podrobné operační manuály, které obsahovaly podrobný postup řízení programu včetně jeho publicity, jeho administrace, finančního řízení a kontroly programů a projektů. Podrobná pravidla postupu pro žadatele a příjemce podpory pak stanovilo pro každé příhraničí v příručkách obsahujících potřebné formuláře a vzory písemností týkající se žádosti o podporu, poskytnutí podpory a hodnocení projektu. Postup pracovníků MMR při řízení programů byl podrobně popsán v manuálu interních postupů.
1.2 Programová dokumentace na úrovni CÍP, programových dodatků, operačních manuálů a
příruček pro žadatele a příjemce podpory byla velmi podrobná a obsáhlá a MMR ji v průběhu
realizace programu měnilo. Např. příručky pro žadatele a příjemce dotace a operační manuály
vydalo v 6. až 7. verzi. Orientace v pravidlech programů byla pracná pro následnou kontrolu i
pro příjemce podpory, kteří byli mimo jiné podle Podmínek poskytnutí dotace povinni při
naplňování účelu dotace postupovat v souladu s programovou dokumentací.
1.3 Vztahy a odpovědnost jednotlivých států při řízení, implementaci, kontrole a komunikaci
s Evropskou komisí byly vymezeny u programů spolupráce s Rakouskem, Slovenskem a
Polskem Memorandy o porozumění uzavřenými mezi Českou republikou zastoupenou MMR
a příslušnými zahraničními partnery (příslušným ministerstvem či spolkovým kancléřstvím).
U programů spolupráce se Saskem a Bavorskem byla tato oblast upravena prostřednictvím
dohod uzavřených mezi MMR a příslušným saským a bavorským ministerstvem (příloha
č. 15).
Usnesením z 5. května 2004 č. 432 vláda uložila ministru pro místní rozvoj, aby memoranda uzavřel v průběhu května 2004. MMR tento termín nesplnilo (viz. tabulka č. 4) a programy od července 2004 realizovalo. Jako důvod uvedlo prodlevu smluvních partnerů při projednáváni dokumentů (příloha č. 16).
Translation - English Between 2004 and 2006, the Interreg IIIA program was part of the Interreg III Community Initiative, which the European Commission formed on April 28, 2000 for the general purpose of preventing borders between individual country states from preventing a balanced development and integration of EU countries. The initiative had three parts, where part A focused on cross-border cooperation and to which the Czech Republic had joined in 2004 through five near-border programs with Germany (Saxony and Bavaria), Austria, Slovakia and Poland.
Interreg IIIA was financed as part of structural funds taken from EU Regional Development Funding (hereafter only ERDF) and was governed by the relevant regulations issued by EU bodies, in particular:
- Council Directive (EC) 1260/1999 from June 21, 1999 concerning general regulations regarding structural funds;
- European Parliament and Council Directive (EC) 1783/1999 from July 12,
1999 concerning the European Regional Development Fund;
- A report by the European Commission from September 2, 2004 which sets general principles for community initiative relating to Europe-wide cooperation for the purpose of supporting harmonious and balanced development of European regions, Interreg III
(2004/C226/02) - hereafter only „Principles of Interreg".
On a national level the program was governed by regulations valid for financing programs from the state budget, in particular Act 218/2000 Coll. of budgetary rules and Public Notice 40/2001 Coll., in its later wording.
1. Program Management
The fundamental program documents included the Community Initiative Programme - hereafter only CIP [CÍP]), prepared by MRD in conjunction with the relevant foreign parties for each near border region, which is Saxony, Bavaria, Austria, Poland and Slovakia, between 2004 and 2006. The CIP for Germany (Saxony, Bavaria) and Austria was created by revising the original program documents, based on which these states drew support from structural funds prior to Czech Republic's entry into the European Union.
1.1 All CIPs were approved by government decree 432 from May 5 of 2004 and thereafter by the European Commission (Appendix 14). The first version of CIP was submitted to the European Commission by the governing bodies (in Poland it was MRD, as will be further stated) between August 2003 and February 2004. They were then approved by the European Commission between October and November of 2004 and were later revised to the second or third versions during the program period.
The CIP included social-economic analyses of the relevant neighbouring regions, a brief description of goals, the program's priorities and measures, and methods of their realisation, evaluation, financing and implementation, which the MRD expanded in detail in program appendices, which when submitting the Polish cooperation program kept the European Commission in mind (with other programs the program appendices were submitted by the relevant governing body). Besides this the MRD had also prepared for each neighbouring region detailed operation manuals containing detailed procedures of managing the program including its publicity, administration, financial management, and monitoring of programs and projects. It then set detailed rules of procedures for each applicant and recipient of support for each neighbouring region in manuals containing necessary forms and document samples relating to applications for support, provision of support, and project evaluation. The procedures to be followed by employees of MRD during the management of programs was described in detail in the manual of internal procedures.
1.2 Program documentation at the level of CIP, program appendices, operation manuals and manuals for applicants and recipients of support was very detailed and extensive, and was amended by the MRD during realisation. For example, it issued 6th and 7th versions of operation manuals and manuals for grant applicants and recipients. Orientation among the rules of the programs was laborious for subsequent monitoring also for the recipients of support, who were, according to the Conditions of Providing Grants and while fulfilling the purpose of the grant, required to proceed according to the program documentation.
1.3 The relations and responsibilities of individual states during management, implementation, monitoring, and communication with the European Commission were limited to cooperation programs with Austria, Slovakia and Poland by a Memorandum of Understanding concluded between the Czech Republic (represented by the MRD) and the relevant foreign partners (the relevant ministries or federal offices).With cooperation programs with Saxony and Bavaria, these regions were governed by agreements concluded between the MRD and the relevant Saxony and Bavarian ministries (Appendix 15).
By decree 432 from May 5, 2004, the government charged the ministry for regional development with the task of concluding the memorandum during May of 2004. The MRD failed to meet this schedule (refer to Table 4) and realised the programs from July of 2004. For justification it blamed the delay of contract partners when discussing the documents (Appendix 16).
