A Vale e o Ministério do Meio Ambiente (MMA) assinam hoje (11/07) termo de compromisso pelo qual a empresa se compromete a vender minério de ferro para produtores de ferro gusa que utilizem em sua cadeia produtiva apenas produtos ambientalmente legais, ou seja, madeira e carvão certificados. A medida reforça o compromisso da Vale com o desenvolvimento sustentável das regiões onde atua e representa mais um passo da empresa no combate ao trabalho escravo e ao desmatamento ilegal.
No ano passado, a Vale suspendeu unilateralmente o fornecimento de minério de ferro para nove guseiras de Pará, Maranhão, Espírito Santo e Minas Gerais por desrespeitarem as legislações ambiental e trabalhista. Desse total, apenas quatro voltaram a receber o minério regularmente, depois que se ajustaram à lei. Uma está recebendo o produto por determinação judicial e as demais tiveram seus contratos rescindidos ou suspensos.
De acordo com o texto do termo de compromisso com o MMA, a Vale manterá, nos contratos com clientes, cláusulas que lhe atribuam a obrigação de observar a legislação ambiental relacionada às suas atividades. A qualquer momento, a empresa poderá suspender o fornecimento de produtos ou a prestação de serviços caso haja desobediência à lei declarada por decisão das autoridades competentes.
Segundo o documento, ficam caracterizadas como ambientalmente legais as guseiras que comprovadamente estão autorizadas a operar pelo órgão ambiental. Para isso, as empresas deverão apresentar documentos comprobatórios da licença ambiental, plano de suprimento sustentável e documentação de origem do carvão vegetal ou documentos oficiais que os substituam.
O termo de compromisso prevê, ainda, que a empresa irá contribuir pró-ativamente em relação à sustentabilidade na cadeia siderúrgica e no combate ao desmatamento, embora ressalte que a responsabilidade quanto à caracterização da legalidade ou não cabe sempre aos Governos federal e estaduais. A Vale também se compromete a cooperar com o Governo federal para estabelecer um processo transparente para a certificação e rastreamento da madeira e do carvão vegetal produzido no país.
Através de parceria com o Ibama, a empresa se propõe a ajudar os guseiros na busca por soluções sustentáveis para suas atividades e incentivar a aproximação do setor com entidades de financiamento externas. Além disso, o documento prevê o apoio da empresa para a criação de regras e sistemas necessários que permitam ao Governo federal o monitoramento do setor madeireiro e siderúrgico à base de carvão vegetal nacional.
Caberá ao Ministério do Meio Ambiente, segundo o acordo, implementar os marcos regulatórios e o modelo de gestão que, respeitando os papéis e responsabilidades de cada parte, incentivem o desenvolvimento sustentável nas regiões de florestas. Essas ações incluem:
• Implementação e indução para que Governos estaduais e municípios também façam ações coercitivas para impedir atos ilegais de qualquer espécie que levem ao desmatamento ilegal;
• Promoção e implementação do cadastro e licenciamento ambiental das propriedades rurais, em conjunto com os órgãos estaduais;
• Apoio e promoção à implementação do Zoneamento Econômico Ecológico nas regiões de interesse, notadamente na Amazônia Legal;
• Promoção do reconhecimento da relevância do carvão vegetal como insumo renovável para siderurgia e, conseqüentemente, como elemento relevante para combate ao aquecimento global;
• Busca de acordos com entidades financeiras que, respeitados acima de tudo o interesse e a soberania nacional, permitam a atração de incentivos financeiros para a preservação e recuperação de florestas do país;
• Apoio à implementação de projetos de reflorestamento de áreas degradadas.
Translation - English Vale and the Ministry of the Environment sign an agreement against the use of illegal timber and vegetable charcoal
Vale and the Ministry of the Environment signed, today (07/11), a formal agreement in which the company makes a commitment to sell iron ore exclusively to producers of pig iron that only use environmentally legal products in their production operations, in this case, approved timber and charcoal. The measure reinforces Vale’s commitment to the sustainable development of the regions in which it operates and, represents one more step by the company in the battle against slave labor and illegal deforestation.
Last year, Vale unilaterally suspended the supplying of iron ore to nine pig-iron producers from the states of Pará, Maranhão, Espirito Santo and Minas Gerais, for disregarding labor and environmental legislation. Of these nine, only four have begun to regularly receive the ore, after making adjustments to meet the requirements of the law. One producer is receiving the product under a judicial ruling, while the rest have had their contracts rescinded or suspended.
Under the agreement with the MMA, Vale will include clauses which obligate the observation, in all operations, of environmental legislation in contracts with its clients. The company may, at any time, suspend the supplying of products or providing of services should disobedience of the law be cited by relevant authorities.
According to the document, pig-iron producers that are legitimately authorized to operate by the environmental organization will be termed environmentally legal. For this to happen, the companies must present documentation that proves environmental licensing, a sustainable supply plan and the origin of the vegetable charcoal, or the official documentary equivalent.
In addition, the agreement stipulates that the company will pro-actively contribute to sustainability in the metallurgical industry and in the fight against deforestation, though emphasizing that responsibility for definition of whether an operation is legal or not does not always fall to Federal and State governments. Vale also commits to cooperating with the Federal government in establishing a transparent process for the certification and tracking of timber and vegetable charcoal produced in the country.
Through a partnership with Ibama, the company proposes to aid pig-iron producers in the search for sustainable solutions for their operations, as well as to encourage relations between this sector and foreign financing organizations. Beyond this, the agreement stipulates support of the company in the creation of the necessary rules and systems that will allow the Federal government to monitor the sectors of timber and metallurgy based on domestic vegetable charcoal.
According to the agreement, it will fall to the Ministry of the Environment to implement regulatory landmarks and the management model which, respecting the responsibilities of each party, encourage sustainable development in forested regions. These include:
• The implementation of cooperative action in order to impede any type of illegal act that leads to illegal deforestation and, the encouraging of State and Municipal governments to do the same;
• The promotion and implementation of environmental registration and licensing of rural properties, in conjunction with State organizations;
• Support and promotion of the implementation of Ecological Economic Zoning in the regions of interest, most notably that known as the Legal Amazon.
• Promotion and recognition of the relevance of vegetable charcoal as a renewable raw material for metallurgy and, consequently, as an important factor in the combat of global warming;
• Solicitation of agreements with financial organizations which, respecting above all else national interests and sovereignty, permit the attraction of financial incentives for the preservation and recuperation of the country’s forests.
• Support of the implementation of reforesting projects in afflicted areas.
