الدستور لفظة غير عربية يراد بها عدة معاني من أهمها القاعدة أو الأساس ، وأكثر ما تستخدم هذه الكلمة في عالمنا المعاصر في المجال السياسي، ويراد به القانون الأعلى في الدولة فهو بهذه المثابة أبو القوانين الذي تنبثق منه بقية القوانين التي تحكم المجتمع في مجالاته المتعددة كافة، حيث يُنص فيه على شكل الدولة وطبيعة الحكومة وآليات الحكم والسلطات العامة في الدولة وطبيعتها فيبين ما السلطات العامة وكيفية تكوينها واختصاصات كل سلطة وحدودها والعلاقة بين السلطات وصلاحيات كل سلطة وكيفية الرقابة على السلطات . ولذلك يعتبر من "شؤون البشر" فهي لم تستند لنمط معين، بقدر ما توجد كليات تحكمها.

والدستور غريب في لفظه وإحالته على الفقه السياسي الإسلامي في عصر الراشدين وما تلاه من العصور، وإن كان كل ما يتضمنه الدستور تدل عليه أحكام الشريعة سواء بالموافقة أو الرفض، ولعل أول دستور عرفته البشرية بمفهومه الحديث كان في سقيفة بني سعد، وحددت الحقوق والحريات للأقليات . والمؤلفات في الأحكام السلطانية مما يمكن أن تعد النواة لكتابة الدساتير في الفقه السياسي الإسلامي ولو تفحصنا كتابا مثل كتاب الأحكام السلطانية للماوردي وجدناه يشتمل على الحديث في كثير من الأمور التي تتضمنها الدساتير حيث عقد بابا للإمامة (رئاسة الدولة) تكلم فيه عن حكم نصب الإمامة وشروط الإمام، وكيفية وصوله لمنصبه وشروط من يختاره لهذا المنصب، ثم تحدث عن واجبات الإمام أي حقوق الملة والأمة تجاهه وحقوقه على الأمة، كما تحدث عن المسوغات التي يفقد بها الإمام منصبه إذا تحققت فيه، وعقد بابا للحديث عن الوزارة فبين أنواعها والشروط التي ينبغي وجودها فيمن يلي هذا المنصب وعقد بابا للحديث عن أمراء الأقاليم وبابا في الحديث عن الإمارة على الجهاد وبابا في الحديث عن الولاية على حروب المصالح وكل ما تقدم يدخل فيما يسمى الآن بالسلطة التنفيذية، كما عقد بابا في ولاية القضاء تحدث فيه عن شروط من يتولى القضاء وكيفية انعقاد ولاية القضاء وحدود ولاية القاضي وهذه تعد بالمعايير المعاصرة السلطة القضائية، كما عقد بابا لولاية المظالم وهي معنية بالنظر في المقام الأول في تعديات الولاة على الرعية و تعد في أيامنا هذه من باب القضاء الإداري.
Translation - Arabic
The word “dostoor” (Constitution) is originally a non-Arabic lexicon, which has several meanings including, most importantly, the base or foundation. This word is mostly used in the contemporary world of politics. It denotes the primary law from which the other laws are derived to govern a society in all the different fields. The Constitution sets forth the nature of a nation, nature of its government, governance mechanisms and general authorities in the nation and their nature; it explains what the general authorities are, how they are formed, their respective duties and responsibilities, the relationship between authorities, the powers of each authority and how control is assumed on the authorities. Therefore, a constitution is “an affair of human beings”; there is no specific pattern followed but there are overarching principles which govern the constitution.

A constitution is strange in terms of its lexical derivation and reference to the Islamic political jurisprudence during the Rightly Guided Caliphs era and during subsequent eras, even if all that a constitution includes is expressed by the provisions of Islamic Sharia whether by approval or disapproval. Perhaps the first constitution ever introduced to humanity, in its modern meaning, was the one in Saqifat Bani Saad, where the rights and liberties of minorities were determined . This also includes the publications about the ordinances of government, which could be deemed the nucleus for drafting constitutions in the Islamic political jurisprudence. Examining a book such as Kitab Al-Ahkam Al-Sultaniya (Book on Islamic Ordinances of Government) written by Al-Mawardi, we will find that it includes many matters which were tackled by constitutions. In this book, there is a chapter dedicated the caliphate (the presidency of the state) wherein he explained the rules governing the appointment of a caliph or governor, the characteristics and qualities of a ruler, how a person can attain the position of a ruler and the requirements such person must meet. Al-Mawardi then discusses about the duties of the ruler, i.e. the duties and responsibilities a ruler must fulfill towards Islam, towards the Nation and his own rights. He also discusses the justifications why a ruler would lose his position. Al-Mawardi dedicated an entire chapter to discuss Al-Wizarah (the minister’s position) demonstrating the types of such a position and the conditions a person who would act as the minister must meet. A chapter was also dedicated to provide more explanations about the princes of provinces and another one was dedicated the characteristics for right person to be appointed as the commander in jihad. The book has a chapter on what the commander of interest wars is like. All the foregoing headings are now termed as the “executive authority”. Al-Mawardi dedicated a chapter for the judge’s position, wherein he explained the conditions for assuming a judge’s position, the limits of the judge’s jurisdictions. Such are the contemporary standards for the judicial authority. The book has a chapter on the entity undertaking grievances, which is concerned in the first place with the encroaches of the rulers on the public, which is contemporarily termed as the “administrative judicial authority”.
