disagree  Charles Ek: Like the Swedish term, a frivolous appeal is one which has no merit whatsoever; a vexatious one has no merit and is intended to annoy the other party. I don't see vexatious intent in this case or in examples like this one: http://tinyurl.com/mc3bp6j
