Cuando en la fecha de 'promoción' del expediente de pensión, el matrimonio no formalizado se encuentre pendiente del reconocimiento judicial, la certificación de éste podrá suplirse con información de testigos sobre la unión estable y singular del causante y su pareja, siempre que en el expediente de pensión se acredite, mediante investigación realizada por el Director de la Filial Municipal del Instituto Nacional de Seguridad Social, la singularidad y estabilidad de la unión y que el promovente reúne los demás requisitos exigidos por la Ley de Seguridad Social.
