Wage earner or wage earning capacity or activity. Maybe your funcion dilemma could be resolved by simply saying "is not a wage earner". At least a possibility of an alternate phrasing for the different wordings.

but I think you may be reading too much into it. Of course, I'm very quick on the trigger (perhaps too much so) when it comes to dismissing these phrases as meeting the required standard for ornate repetitions of Spanish officialese. So beware there.
If you want to differentiate, what about either "compensation"of "for pay" into the equation using Bernadet's not engaged in. As in not engaged in any activity for pay. Not carrying out any kind of compensated activity. And stick the gainfully employed with your funcion phrase since I don't how you'd work around that word.

I have a peculiar predicament here. Because I’m actually going to use your suggestion for a similar term from the next paragraph, Altogringo. This next paragraph (which I should have posted) is this:

“Tendrá el mismo derecho quien precise encargarse del cuidado directo de un familiar, hasta el segundo grado de consanguinidad o afinidad, que por razones de edad, accidente o enfermedad no pueda valerse por sí mismo, y que no desempeñe actividad retribuida."

Which I’m translating as this:

“...who for reasons of age, accident or illness cannot look after themselves and are not gainfully employed.”

The particular problem I have with “que no desempeñe una función retribuida” is what to do with “función”?? I feel it has been carefully selected because it’s referring to “un minusválido físico, psíquico o sensorial”. Dunno, maybe I’m reading too much into it...

What does anyone else think?
