– Ustupitelj ili svaki drugi otuđilac, na nepokretnostima koje su otuđene radi ispunjenja obaveza koja potiču iz otuđenja;

The Article 563 of the Civil Code defines the cases in which a legal mortgage is imposed. According to this provision are entitled to a legal mortgage:
– the transferor and every other alienator, on the immovables alienated for the performance
of obligations arising from the alienation;
