Not sure what it means in this context (purchase of property), talking about joint and several liability:

I think escussione di means claiming against or pursuing of (buyer co. as the object) and not by (co. as the subject). But my Ital. preps. are none too good.

I'd forget 'excussio' and benefit of 'discussion', unless for Roman-based Scots law purposes:- 'discuss: to use diligence (enforcement)against the principal debtor before using it against a cautioner (guarantor). Also see 'beneficium ordinis' -> benefit of discussion: the (secondary?) debtor's right to insist that the creditor proceed first against the principal debtor'. Butterworth Scottish Law Gloss.

Dei rapporti tra creditore e fideiussore

Art. 1944. Obbligazioni del fideiussore. Il fideiussore è obbligato in solido col debitore principale al pagamento del debito (1292, 1410, 2871).
Le parti però possono convenire che il fideiussore non sia tenuto a pagare prima dell’escussione del debitore principale. In tal caso, il fideiussore, che sia convenuto dal creditore e intenda valersi del beneficio dell’escussione, deve indicare i beni del debitore principale da sottoporre a esecuzione (2268, 2868)(1).

Salvo patto contrario, il fideiussore è tenuto ad anticipare le spese necessarie.
