Tale impostazione teorica ci sembra presti il fianco a rilievi poiché, da una parte, essa prende le mosse dall'affermazione apodittica dell'indeterminatezza dell'oggetto tutelato dal delitto de quo ciò mentre, come precisato dalla dottrina maggioritaria, il traffico di influenza è volto a proteggere l'imparzialità della P.A. e la probità dei funzionari pubblici ; dall'altra, essa giunge alla conclusione secondo la quale le condotte di traffico di influenza che ottengono atti conformi ai doveri d'ufficio sarebbero prive di offensività, senza cogliere nella giusta misura come, in realtà, anche tali fatti ledano l'imparzialità della P.A.

Such a theory seems to give rise to remarks because, on one side, it goes far from the 'apodittica' affirmation of the open-endedness of the object protected from the crime de quo, while as precised in the 'main' doctrine, the influence peddling is aimed to protect the impartiality of the P.A. and the probity of the public officials; on the other side, it comes to the conclusion as for which the influence peddling’s conducts, which obtain acts conform to the office’s duties, is devoid of offence, without realizing how even those facts in reality are injuring the P.A.’s impartiality.
