Italian term or phrase: regolarizzazione del rapporto di lavoro
Appears in a "RICORSO EX ART. 414 C.P.C" where a former Italian employee of a foreign bank is suing his former employer because, although he was formally declared as an employee under the law of a foreign country for tax reasons (a decision of the foreign bank and not his), in reality he was actually based in Italy because he carried out the majority of his work there and was therefore subject to the provisions (and rights) under Italian law.

Here the former employee, in an extract from a letter sent by his lawyers to his former employer, is asking for the employment contract to be formally made into an Italian employment contract, however I'm not sure how to translate "regolarizzazione".

Mr XXX, pertanto, Vi chiede la *regolarizzazione del rapporto di lavoro*.

In other cases the term "regolarizzato/a" is used, e.g.:

"Si precisa che [former employer] aveva sempre rassicurato il Mr. XXXX che la situazione sarebbe stata *regolarizzata* non appena terminata la fase di avviamento del progetto."

"Mr XXX, decorso il primo periodo di start up, fece presente l’anomalia della situazione ed ogni volta la Società replicava che il tutto sarebbe stato *regolarizzato* sia sotto il profilo della stabile organizzazione (onde evitare rischi fiscali) sia sotto il profilo del rapporto di lavoro (onde assicurare il rispetto della legge locale).

self explanatory. It is illegal to employ someone in Italy and not subject them to Italian labour legislation, unless they have a foreign contract stating that they are only temporarily assigned to Italy (but they would still be subject to Italian taxation etc)

I think you will need (as always, with Italian legalese!) to turn the phrases around a bit, and that 'regolarizzare' may well be translated in different ways for the two different examples, but 'formalize' would also be a good option, imo. Hope to help

Hi Lorraine, in the end, upon inspiration from your two suggestions, I went for "legally formalise", which I think worked here. You were right of course, the translation varied according to the context, in other instances I used "remedied" for example in the phrase "la situazione sarebbe stata regolarizzata"

As regards the second use of "regolarizzato", I would go for something simple like "sorted out" since it's reported speech rather than an actual legal claim.

Reference information:
yes, I agree with Jim's comment - the thing is this person was registered for social security/pension purposes in another country, hence his "posizione INPS" is messed up, and legally incorrect. what he is requesting is that his employment during this time be recorded correctly with the correct institutions, i.e. the Italian inps, inail, etc. I just can't seem to find the correct wording for this.
