Order of Discontinuance (of suit) Explanation: Nem szeretek szótárszerkesztőket kritizálni, de az ítélet és a végzés két külön jogi fogalom. A permegszüntető VÉGZÉS nem lehet "judgment". A judgment ítélet magyarul, míg az ORDER a végzés. A "permegszüntető végzés" angolul "order of discontinuance" (azaz "order of discontinuance of suit"). A "for" prepozícióval is használt: "order for discontinuance". judgment of non-prosequitur Explanation: Igen használható, és ez a helyes, viszont az USA jelenlegi joggyakorlata alapján default judgment for the defendant-nek fogják írni. -------------------------------------------------- Note added at 2 hrs (2011-11-28 19:45:35 GMT) -------------------------------------------------- Lásd a Magyar-angol-magyar jogi szakszótár 146. oldalát is. Ha csak végzés volna magában, akkor nem fordíthatnánk judgmentnek, viszont egy jelző gyakran más kategóriába terel bennünket. Itt van két példa: az ítélet az judgment, viszont a választottbírósági ítélet az arbitration award, a válóperes ítélet pedig divorce decree. A lényeg az, hogy melyik kifejezés viszi közelebb a célnyelv anyanyelvi beszélőjét a fogalom megértéséhez és itt sokszor nyelvi hagyományok is közrejátszanak. |
