A magyar jogban (a Btk. szerint) a bűncselekmény lehet bűntett vagy vétség (Btk. 11§).

„Bűntett az a szándékosan elkövetett bűncselekmény, amelyre a törvény két évi szabadságvesztésnél súlyosabb büntetés kiszabását rendeli el. Minden más bűncselekmény vétség.”

Tehát a gondatlanságból elkövetett bűncselekmény vétség (jelen esetben konkrétan szerepel a kifejezésben a gondatlanság).

A bűncselekmény minősítését már a büntetőeljárás bírósági szakaszát megelőző eljárási cselekmények (nyomozati, ügyészi) során is pontosan meg kell határozni. A megalapozott gyanú azért még mindig csak gyanú, - reasonable suspicion. A bizonyítékot a bíróságnak el kell fogadnia ahhoz, hogy a "gyanú" ténnyé váljon.

A "driving without due care and attention" a "careless driving" hivatalosabb megfogalmazása. A szöveg hivatalosságának mértékétől függ, hogy melyiket használnám.

Hozzá lehetne tenni, hogy "public" road, de akkor kicsit át kell fogalmazni:

De még itt is a "due care and attention"-t használják, mert az első minősítés igazából csak akkor történhet meg, miután a tényeket megállapították és a gondatlan járművezető ellen vádat emelnek:

disagree  JANOS SAMU: Mint említettem korábban, a forrásszöveg egy szóval sem említi, hogy a vezetés okozta a közúti balesetet. Ha pl. a munkások egy csatornanyílás feledelét az úttest alatti aknából jelzés nélkül elmozdítják, akkor ők okozhatják a közúti balesetet.

agree  Ildiko Santana: Nem nagyon lehet ennél jobbat kihozni ebből a förtelmes mondatból. :) Hozzátenném, hogy a "gondatlan"/"gondatlanság" a jogban "negligent"/"negligence", bár a "gondatlan vezetés" valóban "reckless driving".

A suspicion beyond reasoable doubt sok esetben előfordult bírósági tolmácsolásaim során is, különösen annak megállapításánál, hogy a rendőrség jogosan kutatta-e át a megállított járművet. Legtöbbször azt állapították meg, hogy a suspicion beyond reasonable cause kimeríti a "probable cause" fogalmát. Ugyanakkor a Magyar-angol-magy jogi szakszótár 67. oldalán szintén szerepel "alapos gyanú" = suspicion beyond reasonable doubt.
