Hungarian term or phrase: cselekvőképességet kizáró gondnokság
A cselekvőképességet érintő gondnokságnak két fajtája van: a cselekvőképességet korlátozó vagy a cselekvőképességet kizáró gondnokság. Kizárólag a bíróság jogosult a törvényi feltételeknek megfelelően gondnokság alá helyezést elrendelni. A magyar Ptk. 15. § (4)szerint:

A cselekvőképességet kizáró gondnokság alá a bíróság azt a nagykorú személyt helyezi, akinek ügyei viteléhez szükséges belátási képessége – pszichés állapota vagy szellemi fogyatkozása miatt – tartósan teljes mértékben hiányzik.

Ptk. 12/B. § (2):

Cselekvőképtelen az a tizennegyedik életévét már betöltött kiskorú is, akit a bíróság cselekvőképességet kizáró gondnokság alá helyezett. A gondnokság alá helyezési eljárásra a nagykorú személy gondnokság aklá helyezési eljárása alkalmazandó. A cselekvőképességet korlátozó pedig "partial guardianship of incapable adults".
Ha nagyon részletes pontossággal akarjuk kifejezni, akkor hozzá lehet tenni:
full guardianship of fully incapable adults;
de nincs rá igazán szükség, mert a full guardianship utal arra, hogy az illető teljesen cselekvőképtelen, ezért kell a "full" - az önálló cselekvési lehetőséget kizáró gondnokság. Az adult pedig kifejezi azt, amit az általad idézett szöveg meghatároz: a nagykorú személy gondnokság alá helyezési eljárása alá tartozó személyekről van szó.

Itt elsősorban nem a cselekvőképesség mibenlétéről, hanem mértékéről van szó. Különbséget akarnak tenni a hosszú időre teljesen döntésképtelenek és azok között, akiknek van némi megértése és véleménye arról, hogy mi történik velük, vagy az állapotuk változó.
