Explanation:
A római jogból származik ez a kifejezés, és a mai napig használják eredeti formájában.

A perbeli legitimáció (németül: Legitimation zur Sache) fogalma a fél és a per tárgya közötti anyagi jogi kapcsolatra vonatkozik, vagyis azt jelenti, hogy a felperest megilleti-e a keresettel érvényesített jog az alperessel szemben. A fél perbeli igazolásának is hívják, vagyis hogy a perbeli igény jogosultja perelte-e be a per kötelezettjét. A perbeli legitimáció hiánya a kereset érdemi elutasításához vezet.

Az újabb bírósági gyakorlatban a perbeli legitimáció "kereshetőségi jogként" jelenik meg. A kereshetőségi jogról, mint a felperes igényérvényesítési jogosultságáról a bíróságnak mindig ítélettel kell határoznia.

agree  Csilla Takacs: Nem ismertem, de a szótár szerint valóban ezt jelenti. Amit én írtam az a perbeli legitimáció megfelelője.
