Die Abnahme gilt als erfolgreich durchgeführt, wenn der Kunde, obwohl xxx nach Erklärung der Abnahmebereitschaft die Abnahmeerklärung des Kunden unter Setzung einer Nachfrist von fünf Werktagen angemahnt hat, auch innerhalb dieser Nachfrist die Abnahme nicht erklärt oder ohne ausreichenden Grund verweigert.
