Sofern und soweit Funktionsprüfungen beim Lieferanten vereinbart sind, trägt jede Seite selbst die ihr entstandenen Kosten für die erste Funktionsprüfung. Kosten einer wiederholten Funktionsprüfung trägt der AN alleine, soweit die Wiederholung
von ihm zu vertreten ist.

Der AN zeigt dem AG die **Abnahmefähigkeit** und den Abnahmetermin mit einer Mindestfrist von 10 Arbeitstagen an. Es ist ein schriftliches Abnahmeprotokoll zu erstellen.

Die Abnahme des Werkes erfolgt ausschließlich als förmliche Abnahme, sofern das Werk frei von wesentlichen Mängeln ist.
