Hi Everyone,
This is another term from a family history I'm translating from German to English.

CONTEXT: a genealogical record of a family who lived in 19th century Bavaria.

Please don't suggest "exclusionary letter" for, as far as I'm informed, that is strictly a 20th century term and something else altogether in this context. But sadly my research doesn't offer a clear alternative that represents the real meaning.

The historical text is heavily larded with references to various "Briefe" and "Gräflich von Lerchenfeldsches" courts.

Pertinent QUOTES from the text:

"Georg E___ ging am 26.August 1845 eine zweite Ehe ein mit der Bauerstochter Anna Maria P___, geb.1812 in Moosham, gest. 3.November 1874 in Scharmassing, ehelich der Bauersleute Franz Xaver und Maria P___ von Moosham. Aus der 2.Ehe gingen 5 Kinder hervor. Beurkundet wurde die
1. Ehe im Ausnahmsbrief vom 5.Juli 1834, ausgestellt vom "Gräflich von Lerchenfeldsches Patrimonialgericht I.Claße Koefering" - geschrieben 'dem Übernehmer gehörig' und 'dem Übergeber gehörig' - (Kopie 7/ 5 Bl., Kopie 8/ 5 Bl.),
2. Ehe im "Ehekontrakt", den sogenannten 2 Heurathsbriefen (= Heiratsbriefe) vom 7.August 1845, ausgestellt vom "Gräflich von Lerchenfeldsches Patrimonialgericht I.Claße Köfering". Die Gebühren betrugen insgesamt 58 Gulden, für den Schreiber zusätzlich 6 Gulden."

"Am 5.Juli 1834 wird der Hof übergeben, am 7.Juli 1834 heiratet dann der Erbe Georg E___ die Theres K___ aus Wolkering. Sie stirbt nach 9 1/2jähriger Ehe in Scharmassing im Alter von 36 Jahren, 2 Monaten und 16 Tagen. Die im Ausnahmsbrief vom 5.Juli 1834 (Kopie 7) oben auf Seite 1 erwähnten „Georg und A.Maria E___“ sind die Eltern des Hoferben Georg E___- Es müßte richtig heißen: Johann Georg und Anna Maria E___, geborene K___!' Diesen Ausnahmsbrief haben durch Unterschrift bestätigt:
Georg E___ (richtig: Johann Georg)"

As far as my research has uncovered (see below), any such "Briefe" basically refer to various "official documents", e.g. a "Heurathsbrief" is the marriage certificate of that age (right?).

But how to describe an "Ausnahmsbrief" ...?

Neben den Kirchenbüchern sind Kataster und Briefprotokolle Quellen, die die Lebensumstände unserer Vorfahren beschreiben. Kataster ab 1828 beruhen auf der Vermessung Bayerns. Deren Karten und Akten sind auch heute noch von Bedeutung und in ihre Präzision bemerkenswert. Vermessungen wurden in Flurkarten im Maßstab 1:5000 dargestellt. Erstmals erfolgte die Nummerierung aller Grundstücke, die Angabe ihrer Flächen und die Schätzung der Bonität. Ihr Zweck war Abgaben und Steuern als Staatseinnahmen zu begründen. Veränderungen im Besitzstand hielten die Haus- und Rustikalsteuer-Umschreibhefte fest. In Briefprotokollen wurden Verträge rechtswirksam festgelegt. Beispiele sind der Heuratsvertrag, Ausnahmsbrief, Schuldbrief, Kaufbrief, Gewerbsbrief u. ä. Die Zuständigkeit lag in der Niedergerichtsbarkeit.
Der Vortrag von Dr. Heinzlmeir barg eine überwältigende Fülle von Wissen und war eine wertvolle Vorbereitung für den Besuch im Staatsarchiv Amberg.

Anton Huber stellte in seinem Vortrag die Briefprotokolle als wichtige Quelle neben den Kirchenbüchern für die Forschung dar.
Als Beispiel wurde die Familie Pflieger aus Gammelsdorf verwendet, deren Ahnenlinie ohne Briefprotokolle im Jahre 1836 enden würden. Durch die Briefprotokolle konnte die Familiengeschichte bis ca. 1600 zurückverfolgt werden. Sie enthalten Informationen, die in Kirchenbüchern nicht zu finden sind: Sei es das Heiratsgut für die Geschwister, die schwere finanzielle Situation bei der Hofübergabe, Darlehensaufnahme zum Kauf von Nahrung, ein eingekaufter Großvater oder gar der Notverkauf des Hofes: Diese interessante Quelle ermöglicht es, die eigene Familiengeschichte mit Leben zu füllen."

In early America, such documents stipulated that the father would deed land to the son in return for a specified annual payment (say, “120 pounds of pork, 2 barrels of cider”) after the elder’s retirement."

It would appear to be a document drawn up when an older person cedes his property to his children or to a church or other organisation. It stipulates what rights he has, etc..

Retirement contracts seem to have been widespread in northern and central Europe.
