Instruction to litigation

There are several situations in enforcement proceedings where enforcement can turn into litigation or when a party or a participant to enforcement proceedings may be instructed to litigation.

The first situation is objection against an enforcement ruling based on an authentic document. In the event an enforcement ruling is contested in whole or only insofar as it obligates the enforcement debtor to settle the claim, the objection shall be ruled on by the judge who had issued the enforcement ruling.

Asker: Da li je u ovom slučaju sudski postupak isto što i parnični postupak (litigation)? U objašnjenju stoji "Vanparnični postupak pokreće se predlogom fizičkog ili pravnog lica, kao i predlogom organa određenog ovim ili drugim zakonom". Dakle "vanparnični", a u pitanju koje sam postavio je "litigation", dakle parnični postupak. Kontekst je Zakon o izvršenju i obezbeđenju.
