tekintet nélkül a kollíziós jogra Explanation: Amiről szó van, az valóban a jogütközés, azaz kollízió. Ez a nemzetközi magánjog tárgya. A kollíziós jog pedig un. "empty law", vagy "üres jog", mivel nem a jogviszonyt magát szabályozza, csupán különböző "kapcsolóelvek" révén kijelöli az alkalmazandó jogot. A konkrét esetben azonban a felek NY állam jogát jelölik ki alkalmazandó jogként és ezt rögzítik a szerződésben. A másik megoldás is jó, ez talán a szakmai nyelvezetbe jobban illik, de a döntés joga a kérdezőé:) |
