imati nadležnost Explanation: 39. Sud primećuje da on nije imao nadležnost u vezi sa ovim postupkom do 3. marta 2004. godine kada je Srbija ratifikovala Konvenciju. Sud smatra da period koji spada u njegovu nadležnost ratione temporis u odnosu na sporni postupak nije trajao neopravdano dugo, posebno zato što su u ovom periodu sudovi doneli dve presude na dva nivoa. 39. The Court observes that it did not acquire jurisdiction with respect to these proceedings until 3 March 2004 when Serbia ratified the Convention. [sud je] stekao nadležnost / postao nadležan [dana ...] Explanation: It doesn't happen often - the jurisdiction of a tribunal is perceived as something durable/permanent, but nothing is for ever. What may happen more frequently is that some of the legislation applicable to the case changes, but here the whole case has been transferred to another tribunal as it has become competent / its jurisdiction changed. |
