Indien de overmachttoestand drie (3) maanden heeft geduurd, of zodra vaststaat dat de overmachttoestand langer dan drie (3) maanden zal duren, is ieder der Partijen gerechtigd deze overeenkomst tussentijds te beëindigen zonder inachtneming van enige opzegtermijn, met dien verstande dat zodanige tussentijdse beëindiging niet langer mogelijk is nadat de verbintenis waarvan de nakoming door overmacht tijdelijk werd verhinderd, alsnog is nagekomen. Hetgeen reeds ingevolge deze overeenkomst wordt *pro rata afgerekend.*
