وهذا النوع من الشركات يحيزها مالك بشرط اتفاق الصنعة واحمد بدون شرط , ويشترط أبو حنيفة أن تكون فى الصناعة ولايجيزها فى اكتساب المباح كالإحتشاش والإغتنام.
ويحرمها الشافعى وابن جزم فى المحلى.
