ASEGURAMIENTO DE BIENES DENTRO DE UNA AVERIGUACIÓN PREVIA. DEL JUICIO DE AMPARO QUE SE PROMUEVA EN SU CONTRA DEBE CONOCER UN JUEZ DE DISTRITO EN MATERIA PENAL. Si bien es cierto que el aseguramiento de bienes, en razón del órgano que lo emite, es un acto formalmente administrativo, pues el Ministerio Público es una autoridad que depende del Ejecutivo, también lo es que los actos que emite en la etapa de la averiguación previa, consistentes en el aseguramiento, conservación y retención de bienes relacionados con la investigación de un delito, tienen naturaleza intrínsecamente penal, efectuados en ejercicio de las facultades que le otorgan los artículos 21 y 102 de la Constitución Política de los Estados Unidos Mexicanos, como titular exclusivo de la acción penal y encargado de aportar al juzgador las pruebas relacionadas con la acreditación de la existencia del delito y la responsabilidad del procesado, por lo que se concluye que sus actos, diligencias y resoluciones se rigen por las normas sustantivas y adjetivas penales. En consecuencia, el juicio de garantías que se promueva contra las referidas determinaciones, compete al Juez de Distrito en Materia Penal, pues con ello se respeta el principio de especialización que justifica la creación de tribunales especializados y, por ende, el artículo 17 de la Constitución Federal, en cuanto garantiza la expedites en el fallo
