The Dutch government stimulates innovation and R&D activities through corporate income tax incentives in the Dutch Patent and Research & Development Box (the “Patent Box”). In the Patent Box, all profits allocable to self-developed intangible assets that are patented or qualifying research & development activities are subject to a special tax regime at a rate of 10%. The profits covered include royalty income and capital gains upon the (partial) disposal of the assets less their depreciation costs. Trade marks and similar assets do not fall within the scope of this special tax regime.

Este sistema distingue tres tipos de rendimientos, cada uno
de los cuales se grava en un apartado o «box» diferente a un tipo
impositivo también diferente. Los rendimientos negativos de cada
apartado no se pueden compensar con rendimientos positivos de
otros apartados, aunque si se pueden compensar con los rendimientos
del mismo apartado en los siguientes años. En el primer
apartado se incluyen los rendimientos del trabajo y de la propia
vivienda, gravándose a tipos progresivos con un tipo máximo del
52 por 100. En el segundo apartado se gravan los rendimientos de acciones a un tipo fijo del 25 por 100, y en el tercer compartimento, las rentas del ahorro y de inversiones tributan a un tipo del 30
por 100.
