Michael,

I know this isn't relevant for Wendy's question, but I would like to point out that third-country invoices to German clients should contain the following boilerplate so that the recipient doesn't have any problems with the German tax authorities:

"Auf die Steuerschuldnerschaft des Leistungsempfängers gem. § 13b Umsatzsteuergesetz wird hingewiesen.
Attention is drawn to the VAT liability of the recipient of these services in accordance with section 13b o

Michael,

"Auf die Steuerschuldnerschaft des Leistungsempfängers gem. § 13b Umsatzsteuergesetz wird hingewiesen.
Attention is drawn to the VAT liability of the recipient of these services in accordance with section 13b of the German VAT Act."

This is based on a decision (I think by OFD Frankfurt) back in the 2000s. Adding this boilerplate is purely a courtesy to the recipient of the invoice, and the issuer will not suffer any tax consequences if they don't. But it's possible that the German tax authorities might not recognise an invoice without that boilerplate.

I would also like to point out that, in addition to satisfying any requirements of the third country in which the issuer is tax-resident, the invoice must also satisfy other formal requirements of German law applicable to invoices (which are based largely on VAT legislation).

Other countries may have similar requirements (I know Austria has requirements similar to Germany).

The truth about the taxman Oct 2, 2020

Mervyn Henderson wrote:

Does the taxman actually drop by over there, then, to save you the trouble? That's an innovative service, and no mistake.

No chance.

The urban myth, as perpetuated by Tom, is that the taxman is constantly lurking in the shadows, ready to pounce should you so much as transpose 46 pence into 64 pence on your tax return, date an invoice September 31 or put one too many sessions with your preferred lady of the night through the books as CPD.

The rural myth, as perpetuated by my accountant (“Well if you can’t remember doing any business mileage this year, let’s just put down 5,000 miles”), is that the taxman has bigger fish to fry and is only ever going to come after you if you really take the piss and go the full Messi, not when all you’re doing is claiming child benefit for 200 lambs.

The sad reality, however, has been staring us in the face all the time. The taxman is, quite literally, the taxman. One man. No wonder nobody ever answers the bloody helpline. And right now he’s working from home in his PJs with the toddler twins from hell crayoning all over his paperwork, the bolshie teenager from hell hogging all the bandwidth watching dwarf porn, and Taxwoman looking a little too old for those hotpants now and pouring her third G&T of the morning while bemoaning his failure to get with the 21st century and rebrand as the taxperson, it’s a sexist outrage really, and to be honest he’d rather hide in the toilet, crack open a beer and watch the cricket than do any work, so he does.

Which is the real reason why the big corporations and POTUS get away with paying less tax than my cat.

Taxing stuff Oct 3, 2020

Chris, you paint a dire picture of Mr Taxman's home - which I relished! - but I'd like to add a minor nuance.

I reckon Mr Taxman is not targeting the little people. No point. Not enough revenue between them to make it worthwhile, and they'll never pay back the money and/or pay the fine anyway, and if you put them in jail the state pays for it all, plus putting Joe Blow in jail doesn't sit well with the growling masses.

Nor is he targeting the Mr Bigs, because they all

Nor is he targeting the Mr Bigs, because they all have armies of lawyers and accountants and they don't give a gypsy's curse if they have to pay in the end anyway.

No, the smart money is readily available from the people inbetween. Not so much the difference between 46 pence and 64 pence, or 46 million and 64 million, but the difference between 4,600 and 6,400. Taxman might even be able to set his sights on the 46,000/64,000 category. Between them they have the revenue, but they do not have the wherewithal to put up a fight. Every time I hear a politician claim earnestly that SMEs and entrepreneurs are the backbone of the nation I feel that bile rising up, because I see it's only true to the extent that they are the fall guys and fall gals who take every punch for the rest of them, including fiscal uppercuts.
