Source text - English 14. INSURANCE.
(a) Unit Owner shall maintain at all times during the Term, at Unit Owner’s sole expense, with an insurance company acceptable to Hotel Owner, a property and liability policy with a “Condo Unit Rented to Others” endorsement or an equivalent property and liability insurance program covering the Unit. The liability coverage shall be not less than €500,000 per occurrence. The property policy shall be written on a so-called standard “all-risk”, “all perils” or “special risk” form with a 100% replacement-cost basis endorsement and an “inflationary guard” endorsement. The property policy shall include coverage for the Unit’s contents, furnishings and fixtures as well as for any alterations, installations and/or upgrades at the Unit and shall also cover so-called catastrophic perils of flood, earthquake, hurricane, and water damage caused by hurricane. Unit Owner’s policies shall contain deductible clauses in commercially reasonable amounts. Hotel Owner shall have the right to revise these insurance requirements from time to time and to approve all coverages and policies purchased by Unit Owner. Hotel Owner does not provide any form of loss of rental income coverage for Unit Owner. Unit Owner shall have the sole option to acquire this coverage at its own expense.
(b) Unit Owner shall cause each such liability insurance policy to name Hotel Owner, Service Provider, any lender secured by the Hotel, and any affiliates of the foregoing, and their respective partners, shareholders, trustees, members, directors, officers, employees and agents as additional insureds, and shall obtain an endorsement to such policy or policies waiving any rights of subrogation against such parties. All such liability policies shall be written as primary policies, not contributing with or supplemental to the insurance maintained by Hotel Owner or Service Provider.
Translation - Spanish 14. SEGUROS.
(a) El Propietario del inmueble deberá mantener y asumir en todo momento durante el período de ocupación la totalidad de los gastos de un seguro de vivienda con una compañía de seguros aceptada por el Propietario del hotel, el cual recoja una póliza de la propiedad y de responsabilidad civil, abordando el "Inmueble alquilado a terceros", una propiedad equivalente o un plan de seguro de responsabilidad civil que cubra el inmueble. La cobertura de responsabilidad civil no deberá ser inferior a 500.000 € por siniestro. La póliza de la propiedad deberá tener una cobertura estándar de todo riesgo, todos los peligros o riesgos especiales, con un respaldo de base del 100% por costes de reemplazo y una cobertura de protección contra la inflación. La póliza de la propiedad deberá incluir una cobertura para los objetos que conforman el inventario del inmueble, mobiliario y accesorios, así como por modificaciones, instalaciones y/o mejoras en el inmueble, y deberá cubrir además una cobertura por peligro catastrófico de inundación, terremoto, huracán y daños causados por el agua como consecuencia de este tipo de fenómeno meteorológico. Las pólizas del Propietario del inmueble deberán contener cláusulas deducibles en cantidades comercialmente razonables. El Propietario del hotel tendrá el derecho de revisar estos requisitos del seguro periódicamente y aprobar todas las coberturas y pólizas adquiridas por el Propietario del inmueble. El Propietario del hotel no proporcionará ningún tipo de cobertura por pérdida de ingresos en concepto de alquiler al Propietario del inmueble. El Propietario del inmueble tendrá únicamente la opción de adquirir esta cobertura a su propio cargo.
(b) El Propietario del inmueble se encargará de nombrar en cada póliza de seguro de responsabilidad civil al Propietario del hotel, proveedor de servicios, cualquier tercero asegurado por el hotel y cualquier afiliado en general con sus respectivos socios, accionistas, administradores, miembros, directores, oficiales, empleados y agentes como asegurados adicionales. Dicho Propietario del inmueble deberá obtener además un respaldo de la(s) póliza(s), renunciando a cualquier derecho de subrogación contra las partes anteriormente mencionadas. Este tipo de pólizas de responsabilidad civil deberán ser concebidas como pólizas básicas, y no contribuir o complementar el seguro mantenido por el Propietario del hotel o un proveedor de servicios.
