As mentioned in the introduction, in a U.S. governmental investigation such as this one, XXXX has a legal obligation to take reasonable steps to preserve materials that may be relevant to the investigation, and this PN is one of the efforts that the company is taking to fulfill its legal obligation. Source text - Russian Через полгода на новом аукционе Минздрава ситуация повторилась. «Р-фарм», «Протек», «Роста» и «Фармстандарт» по очереди снимались с торгов, позволяя оставшейся компании выигрывать лот по максимальной цене.
В декабре 2010 г. Генпрокуратура объявила, что Следственный комитет при прокуратуре по ЦФО возбудил уголовное дело «в связи с нарушениями законодательства о конкуренции при проведении Минздравсоцразвития аукционов на поставку лекарственных средств». Прокурорская проверка установила, что за 2006-2008 гг. шести компаниям досталось 127 из 164 госконтрактов на сумму 61 млрд руб. из 66,3 млрд. Сотрудник Генпрокуратуры так описывал «Ведомостям» согласованные действия: заявки на торги подавали несколько организаций, но являлся только один участник, торги признавались несостоявшимися, а госконтракт заключался с единственным претендентом по максимальной цене. Федеральная антимонопольная служба также обратила на это внимание и возбудила дело в отношении 18 производителей и дистрибуторов лекарств, которых заподозрила в ценовом сговоре, сговоре на торгах и разделе рынка. Репик сговор отрицает и объясняет, что компания отказывается от аукциона, когда не находит лекарства.

In December 2010, Attorney General (Prosecutor General) declared that the Investigative Committee of the Russian Federation for the Central Federal District opened a criminal case “in connection with the violations of the anti-competition law during the Ministry of Health tenders for supply of drugs.” Attorney General investigation determined that during 2006-2008, six companies were awarded 127 out of 164 public procurement contracts for 61bln RUR out of 66.3bln RUR. Attorney General officer described the following concerted actions to the “Vedomosty”: several companies submitted the proposals but only one participant actually bid, tender was announced invalid, and the public procurement contract was awarded to the single participant at the maximum price. Federal antimonopoly service also noticed this and opened a criminal case against 18 drug manufacturers and distributors on suspicions of price fixing, bid rigging and market division. Repik denies any conspiracy and explains that a company waives its participation in the auction when it does not find the drugs.
Public procurement market lacks transparency and demands review of the tender rules. There is bid rigging at the tenders, the tender documents are often written for the specific drug or distributor that has exclusive rights to a specific drug.” – comments Melik-Guseynov.
