Re: Entitlement to contribute to the Canada Pension Plan
The Canada Pension Plan states that those who are entitled to receive a benefit under the Act are those who have contributed to it. It sets out positively those who must contribute. By inference, therefore, those who have no obligation to contribute have no right to contribute.
The general rule is that contributions are based on income (employment and business) earned in Canada:
Chapter C-8 Canada Pension Plan
Para; 8(1) – Every employee who is employed by an employer in pensionable employment shall … make an employee’s contribution …
Para: 6(1) – Pensionable employment is (a) employment in Canada …
There are exceptions and clarifications defining “employment in Canada” and “excepted employment”, such as ambassadors, none of which apply to you.
Note that the Act’s provisions never refer to your citizenship. Both the Canada Pension Plan and the Income Tax Act refer to “residents” not to “citizens”. The simple fact of being a Canadian citizen does not entitle you to make a contribution to the Plan.
Therefore, during those years when you were a non-resident of Canada, working for a foreign company in a foreign country, you cannot contribute to the Canada Pension Plan nor make a catch-up contribution for “lost” years in order to increase your subsequent pension benefit.

El Plan de Pensión de Canadá especifica que los que tienen derecho a recibir beneficios conforme a la Ley, son aquellos que han contribuido al mismo. El mismo establece claramente quienes deben contribuir. Por ende, aquellos que no tienen la obligación de contribuir no tienen derecho a contribuir.
La regla general es que las contribuciones se basan en los ingresos (de empleos y negocios) producidos en Canadá:
Capítulo C-8 Plan de Pensión de Canadá
Párrafo; 8(1) – Toda persona empleada por un empleador en relación de empleo pensionable deberá … realizar una contribución como empleado …
Párrafo: 6(1) – Empleo pensionable es (un) empleo en Canadá …
Existen excepciones y aclaraciones a la definición de “empleo en Canadá” y “empleos exceptuados”, tales como los embajadores, ninguno de los cuales se aplica en su caso.
Tenga presente que las disposiciones de la Ley nunca hacen referencia a su ciudadanía. Tanto el Plan de Pensión de Canadá como la Ley de Impuesto a la Renta se refieren a “residentes” y no a “ciudadanos”. El simple hecho de ser canadiense no le da derecho a realizar contribuciones al Plan.
Por lo tanto, en los años en que usted no era residente de Canadá y trabajaba para una compañía extranjera en el extranjero, usted no puede contribuir al Plan de Pensión de Canadá ni realizar contribuciones para recuperar los años “perdidos” a fin de incrementar los beneficios posteriores de la pensión.
