Romanian law does not expressly provide for class proceedings. It
is, however, possible for individual natural persons or legal entities,
each suffering individual damages, to act together as plaintiffs or
defendants, combining their claims into one single claim, provided
that the matter of controversy is a common right or obligation or that

According to Cabanellas, joint litigation but: Activo (if there are several joint plaintiffs) and Pasivo (if there are several joint defendants)

Coincido  Nelida Kreer: I had not read Richard's comments when I gave my agree to Mike. Fully agree with Richard, Layla will have to see how she phrases it, but it would seem that this is a case of procedural omission where not all the concerned parties were notified. Saludos.

Coincido  RichardDeegan: Necessary parties/litigants. Not necessarily codefendants. Could be other plaintiffs without which a case may not proceed (class action, parent/ custodian for a minor plaintiff, GAL, adminsitrator for a bankrupt plaintiff, etc etc

joinder of defendants


Explicación:
"litisconsorcio" (generally one word rather than two) should not be confused with a "consortium", or is it the "litigation". It means that you cite all the parties to a dispute, be they complainants (i.e. "litisconsorcio activo" -- like a class action) or defendants ("litisconsorcio pasivo").
In this case, the law requires that the plaintiff cite all defendants in its claim (all the shareholders of WZ). I understand the claim is rejected on the grounds that it failed to address all the potential defendants.
