Je ne comprends pas cette notion de cause of action, tournant autour de "motifs" / "raisons de l'action" dans la phrase suivante, du moins je n'arrive pas à l'articuler en français : "if a party secures any such interim or conservatory measures, the other party agrees to pay to the first party an amount equal to the aggregate of its costs of obtaining such relief and any damages incurred by the first party as a result of the cause of action giving rise to such a claim".

De rien. En effet je ne pense pas que ce soient les motifs de la première partie qui sont préjudiciables, puisque c'est elle qui a subi le préjudice (préjudiciable = qui peut porter préjudice). En revanche, j'aime bien "entreprendre ce recours".
