Not admitted for hearing Explanation: I have translated the above paragraph in English: Since the Commissioner of the District Wasit has filed the suit referring to his position as Commissioner in spite of the fact that he had resign from his position, therefore, his suit cannot be admitted for hearing under Section-4 of the Procedural Law No.83 of 1969. Where a suit is not admissible for hearing the court may suo mot dismiss the case without going into it details in accordance with Section-80 of the Code of Civil Procedure. Therefore, the Supreme Federal Court has dismissed the case with ordering that the plaintiff would be liable for the costs of litigation in accordance with Article-94 of the Constitution of the Republic of Iraq of 2005. |
