Before analyzing the contrast between Article 61(5) of the IPC and Article 10(6) of EC Directive no. 83/2001, it is important to closely examine the content of the Community provision.
EC Directive no. 83/2001, as amended by Directive no. 27/2004 (hereinafter simply called “the Directive”), introduces the so-called “EC Bolar Type Exemption” (hereinafter the Bolar Exemption), a specific exemption which permits, for the cases expressly governed by the law, an exception from the rules introduced by the various European Countries concerning patents or supplementary protection certificates for medicinal products.
The purpose of such Community provision is a response to the need to ensure that all the companies that have applied for the marketing authorization of a certain pharmaceutical product may conduct and complete all of the necessary tests and procedures for the production and distribution of the product before the expiration of the patent and related Supplementary Certificate (SPC), without such involving a risk of violating the patent’s exclusivity.
With the introduction of this provision, the Community legislature intended to prevent an excessive extension of the timetable for the product’s entry into the market following the expiration of the patent. Such excessive expansion of the timetable would indeed inevitably risk becoming an illogical de facto extension of the patent’s exclusivity.
Moreover, the Bolar Exemption does not cover all types of activities or tests conducted, but applies only to certain applications indicated in Article 10 of the Directive, particularly hybrid applications (paragraph III) or bio-similar applications (paragraph IV).

Prima di analizzare il contrasto tra l’art. 61, comma V, del CPI e l’art. 10, comma VI, della Direttiva CE n. 83/2001, occorre però esaminare più attentamente il contenuto della disposizione comunitaria.
La Direttiva CE n. 83/2001, così come modificata dalla Direttiva n. 27/2004 (d’ora innanzi semplicemente “Direttiva”), introduce la cosiddetta “EC Bolar Type Exemption” (d’ora in avanti Bolar Exemption), ovvero una specifica esenzione la quale consente, nei casi espressamente disciplinati dalla legge, di derogare alle norme introdotte nei diversi Paesi europei in materia di brevetti o certificati supplementari di protezione per i medicinali.
La ratio di tale disposizione comunitaria deve essere rinvenuta nella necessità di garantire a tutte le aziende che hanno presentato domanda per l’autorizzazione all’immissione in commercio di un certo prodotto farmaceutico di condurre e completare tutti gli esperimenti e le procedure necessarie per la produzione e distribuzione del prodotto, prima della scadenza del brevetto e del relativo Certificato Complementare (CCP), senza per ciò detto rischiare di incorrere in una violazione della esclusiva brevettuale.
Con l’introduzione di questa disposizione, il legislatore comunitario ha inteso impedire un allungamento eccessivo dei tempi previsti per l’immissione nel mercato del prodotto, successivamente alla scadenza del brevetto. Tale eccessivo dilatamento delle tempistiche rischierebbe infatti, inevitabilmente, di tradursi in un illogico prolungamento – di fatto – dell’esclusiva brevettuale.
La Bolar Exemption non copre, peraltro, qualsiasi tipo di attività o esperimento condotto, ma si estende solamente a determinate domande, indicate all’art. 10 della Direttiva, in particolare le domande ibride (comma III) o bio-similari (comma IV). |
